Hi,

I plan on entering the USA from Australia to visit my girlfriend. We intend to get engaged soon after my entry and she will send off the forms for the K-1 Visa right away. I will spend 4-5 months with her and then return home to wait for the rest of the time that the forms are being processed.

Is it ok to get engaged and for her to submit the forms after I arrive in the USA and have me stay with her for some of the time like we plan?

Entering from Australia? Does that mean you will be traveling on an Australian passport? If yes, I think you are subject to the VWP and a limited 90 day stay.

we sent the I-129 in august and I stayed from oktober until jan. in the states and we weren`t engaged at the time we sent the petition in. everything went perfect and I got my Visa a few days ago!!

Sure! Get the paperwork together and send it in while you're there. By the time you get back home, you might not have long to wait until your interview. You're luck you can do this. Hope you have a speedy journey! (F)

that is the plan for sure, to spend as much of the wait together as possible, and yes... hopefully there won't be too much wait after I return :)
