Time frame is six months right now.

In your case, ensure you are legally able to marry, which means you have all your papers in order before you apply.

They take a dim view if you apply before you actually have your papers in order...

Good luck and remember to fill in your timeline!

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

At some higher fraud Embassy's things like a recent divorce (or short relationship, or being introduced by family, or supporting your fiance...etc..etc) can all throw up a red-flag that will cause your case more scrutiny but for the most part, and in most places, I believe a CO understands that a marriage can be over long before a final divorce decree is issued. This is most likely the case in Manilla

In our case, I had the packet ready to go and filed the very day my divorce was final... we had already been separated for years. ;)
