Hey All,

If we have already given in all of the needed info related to the I-864 for our I-485 application, will we need to bring additional evidence for the interview? Like stuff from the 2008 tax year?

Hey All,

We went to our interview and everything went well but the IO doesn't want to approve my AOS application due to my wife's income for 2007 was below the poverty line and she told us to file our 2008 income tax return as soon as possible or to find a co-sponsor. We told her that we brought an original paper return and my wife's W-2 for 2008 showing that my wife's income was below the poverty line but yet she still insist to file our return to IRS. Also, she told us that once the IRS accepted our return, we need to send a copy of an email confirmation from IRS that our federal tax return has been accepted along with the copy of our tax return including my wife's W-2s. Same day of my interview, I received my EAD card in the mail, nxt day I went to SSA office and applied for my SSN and nxt day I went there again to ask for the print out of my SSN. I filed my return at the same day I got the print out but it was rejected. I tried to file it again after 4 days and it was rejected again telling me the same reason for rejection. I tried to file our return electronically again on the 5th day and it was accepted. The following day we went to our USCIS local office and handed in our tax return and we're still waiting that something will show up in our mail.

I would like to say that federal tax return for 2008 is vital to file before the date of the interview if your 2007 income was below the poverty line. If your 2007 income was above the poverty line, you'll be fine.

vry true. even thoug my interview was on feb 19 and we had already filed 08 taxes, i didn't bring the recent tax returns. i just walked with the 07, which was the one that i had included in the package. my wife was way above the limit but the IO stil asked for pay stubs..so i guess it would be fitting to file the 08 before you go to the interview if you are below the limit

It's a good idea to bring your 2008 W2(s) and 2008 tax return (if you already filed it). If you haven't file your tax return, just bring W2(s) and that would be fine. On my interview, the officer didn't ask for our 2008 W2s or 2008 tax return. She just said the tax returns from previous years were still good, so I think it depends on the officer. Good luck on your interview
