Okay, I see i can get the forms on this site good.

I have another Question, She is married but has been seperated for 3 1/2 years from her spouse. She also has a soon to be 7 year old that lives with her parents. I know divorce is not allowed there. How will this affect her coming here, or how will effect her if we get married here.

she must be free to marry - she can't do that if she's not divorced/annulled.

You mean she cant come here is she is not divorced or anulled, or do you mean she cant get married here is she is divorced or Anulled?

for k-1 she must be free to marry, as in she must be divorced/annulled or single. if you married there and went the k-3/ir-1 route, it stands a good chance of being found to be bigamy and denied. so you are at a standstill until she's "free to marry" either via a k-1 or via the ir-1/k-3 route.

She told me if she waited 7 years and was seperated from her husband for that time, then she is free to marry, have you heard of this before?

not heard of it, no, but you could ask it in the pi regional forum

my advice - don't take a chance on that and have her go thru with the divorce/annullment process.

She would have to obtain a "CENOMAR" from the NSO, to show that there she is free to marry, if this is Philippines.

I have a slow internet connection today and can't really look into this. I did find this recent post, that's not exactly like your case, but it has some similarity:

http://www.visajourney.com/forums/index.ph...ng+an+anullment

Be careful, because there are companies here in the US that are claiming they can get divorces and annulments there. They appear to be crooks. Post any questions you have here before you proceed.
