EAD at POE jfk

OK hopefully a simple question. I will be flying to America very soon (K1). My plan was to fly to JFK so that i could get an EAD stamp. I have read many post stating that this can be a bit hit and miss.

I've now been told that EAD's will not be stamped at JFK..... I called the customs unit at JFK and was told tht they haven't stapmed EAD's for a year now... which cant be true because people have indicated that they have recieved EAD's recently many without asking (on this forum).....

?????

HELP. has anyone recieved an EAD stamp this year (JFK)

They may or may not do the stamp. The Officer is NOT required to do this stamp.

NOTE: K-1 is not a work visa, it is a fiancee visa for entry to the USA and marriage, K-1 is "Work Auth" primarily to be able to get the SSN, some states are strict in their interpretation of a federal law that requires persons applying for a "license" to have SSN, this can cause a problem with marriage license if only one person has SSN and the other (the K-1 holder) does not.

SSA will issue a SSN to a K1 within 76 days of entry with or without the EAD stamp.

Is now a US Citizen immigration completed Jan 12, 2012.

what if foreign SO had a SSN form a previous work visa (2008)? will he keep this #? will he have to adjust status before being able to work?

SSN is issued for life...

SSN is NOT work authorization

Work authorization required before you can work

Work authorization can either be GC or EAD card

Yes, they will keep the same #.

Timeline:

K-1

07/30/08- I-129F was delivered to Vermont

08/11/08- NOA1

12/14/08- NOA2

02/11/09 Interview (Approved!)

03/07/09 POE at JFK

03/13/09 Married!

AOS

04/08/09- NOA1 for AOS and EAD (we didn't apply for AP)

04/22/09- Case Transferred to CSC

04/24/09- Biometrics Appointment

05/22/09- EAD card production ordered

05/29/09- EAD approval notice sent

06/01/09- EAD arrived in the post

06/18/09- I-485 RFE notice via email

06/25/09- I-485 RFE notice via mail

(They wanted him to redo medical exam- they must've lost it. They also wanted a copy of our marriage certificate, even though we included that in our original submission.)

07/03/09- Medical exam (second one this year grrr!)

07/06/09- I-485 RFE response mailed back to CSC via USPS

07/08/09- I-485 RFE response package delivered at CSC

07/10/09- I-485 Case Processing Resumed (CRIS email)

07/16/09- I-485 Card Production Ordered

07/21/09- I-485 Approval Notice Sent

07/24/09- Green card received in the post!

The I-9 proves that you are legally able to work.. one of the ways to prove that is to have a valid (in date) ead. Temp EADs (90 days) are/were being issued at JFK

I have a job to go to and they will accept a 90 day EAD to start. i'm just trying to workout if this is still a possibility ..... so has anyone entered or know of anyone that has entered this year or for that matter late last year and recieved an EAD stamp??

so when can you then.. it will be a long wait if you need to wait until after the full aos. the EAD that you get whilst waiting for aos is temp too ... 1 year .

Just looked at the i-9 again.

Maybe i'm reading it wrong but if you get a US driving license and SSN then you can complete i-9 by forfilling list B1 and C1?? K1 visa hold can i believe get both.

Just looked at the i-9 again.

I think you will find that the DL will be a challenge in most every state nowadays since most states require evidence of authorized stay of one year and the SSN will come with a wonderful notation... "NOT FOR WORK WITHOUT DHS AUTHORIZATION"

can but hope. but part A4 is the EAD requirement at least it seems to be the one that allows work under an EAD at POE or the 1 year one..... if not then no one can work until after complete AOS... and we no how long that takes

For a K-1 the I-94 expires at 90 days... the stamp (which is is placed on the I-94) expires in concert with that document. My wife got the JFK stamp, so I been there.

You can work once your I-765 is approved (which is filed with the AOS application) and you get the EAD card, this typically is about 90 days to approval. Much shorter than the GC.
