Timeline

Hey!

Just wondering if anyone can shed some light on me. After I get my CR1 , and my ex spouse allows for my kids to come at a later time (after I get a job, , etc is what he's going to be waiting for before he allows the kids to come down) he said he will allow for the kids to come.

Can my new spouse petition my kids as step children, and if so, how is the process, and how long does it usually take? My kids would be in grade school still

First of Welcome, AS far as your children yes your spouse ( as long as he is is a US citizen and marriage took place before childrens 18th Birthday ) can petition your children. He has to file an I-130 for each child and include a copy of the mariage certificate and your childrens birth certificate. The process took us under a year an would have gone a tad faster but we were a little strapped for cash. Also the shortcuts once the case gets to the NVC and the abilitly to pay on line make it even a bit faster. Start getting all your ducks in a row. When you do get to the NVC stage they will request a notorized letter from the childs father stating they are allowed to immigrate to the US. No this is not in any insruction that I saw and we got a RFE for this letter.

Why is it that the only one who can stop the crying is the one who started it in the first place?

Thanks! Same thing for us. Were going to be a bit strapped for cash, so we cant pay all 3 of us at the same time. I just wasnt sure if since they wont be petitioned along with me, if it would take a few years or not, because then Id have to come up with another plan. But if Im correct, according to the timelines , an I130 for children under 21, a step father can petition for them (yes, my boyfriend is USC) he can petition at a later date for my kids (his step children) to move down?

My exhusband doesnt have a problem with it. He's got it notarized that he will allow for them to move down already, with approximate dates and all, and that states that those dates can easily change depending on timelines frequently changing with uscis. I got that done to cover my butt for peace of mind that later on he wont say "uh, they are staying here". So that way hes aware, and has agree'd fully knowing how long it can take.
