Getting Ready to File I-751

Hello,

I am gathering all the evidence I can think of and getting ready to mail it as soon as the 90 days window kicks in.

I am worried about extension letter being delivered to our proper mailbox. Our mailman is messing things up almost every day. I think he is relatively new, and I find my neighbors' mail on a regular basis. We never received some of the credit card statements. What if extension letter never reaches my mailbox?

My employer is extremely efficient as far as checking immigration status, and I am almost positive they will ask me for documents the day my green card expires. Last yer when they asked to see Green Card they made a comment that they made note on their calendar to check with me on 04/25/09.

Anybody have any suggestions?

Thank you very much

Even if you receive the letter you might consider doing an info pass and getting the I-551 stamp in your passport. Some people have had problems with employers excepting the extension letter.

At least you have an option if you have problems.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I think you can just rent a PO box. In the form I-751, there are separate fields for a "mailing address", if it is different from where you actually live.

Cant help you with your mail problem but I can help you with the work and Greencard issue.

When you got your Greencard did you go back to SSA and get the restriction removed off your SSN? If not then you need to do this before your Greencard expires. Once you have an unrestricted SSN all you need to show your employer is your State Drivers Licence or State ID and your unrestricted SSN. Your employer can not demand to see your greencard.

http://www.uscis.gov/files/form/I-9_IFR_02-02-09.pdf

That is the link to the New I-9 form and the instructions are very clear about what documents are allowed and it clearly states your Employer can not choose which documents they want. Its is your choice.

Your employer can "demand" there see your greencard and mine did. I already hard the extension letter but the company immigration lawyer (some fool who doesn't know anything about the immigration process) said i still needed the stamp in my passport, so i just booked an Infopass appointment and had my passport stamped.

My advise to you is simple, just like someone advised, it doesnt cost you a thing (except your time of course) to book an infopass and have your passport stamped that's all.

Thank you all for your replies. You've been very helpful.

The idea to request a new SSN before Green Card expires is great, I will try to do that.

If that doesn't work, the problem is that my passport expires just a few days after my 2 year GC expires. I was planning to have it renewed, but I think I would need to send the old one back to Canada in order to do that? Anyone knows how this works?

Also, if I don't send my old passport for renewal, are they willing to stamp the old expired passport at Infopass? And besides, my passport is still in my maiden name, I am not sure if my employer will accept that either, even though it's clearly me on the passport picture.

Could could always place a hold on your mail and pick it up at the post office or at least file a complaint with the post master in your area.

If you are just getting ready to file for your removal of conditions how far are you into the 90 day window? If you are near the beginning you have time to get your passport renewed. Send it by courier - costs a bit more but is worth the guaranteed arrival - to the Passport Office and they will courier it back to you. Mine took less than 2 weeks from couriering it up to getting the new one back. I would get on it now if I were you, then you have a new passport for the stamp.

Hopefully, you won't need it and your mailman will deliver the NOA correctly.

Hi Kathryn

My GC expires on 04/25 and my passport on 05/09. Did you send your passport to Canada or to Canadian Embassy in the US? Can I request a reneal this early? I have to change my last name on it also. Do you know what is the process to do that?

Thank you very much for your help

Hi Senka,

You can renew your passport up to a year before it expires. Here is the website for all the info: http://www.ppt.gc.ca/cdn/form.aspx?lang=eng&region=USA

I believe that it is sent to Passport Canada in Gatineau, QC. I too got my passport back in a little over 2 weeks after I sent it by courier (the way to go for sure).

I changed my name on my passport too, and I had to fill out a full version application (not the simple renewal one or the online one). Of course I had to send in a copy of my marriage certificate to prove the name change. The instructions on the application are pretty self explanitory.

K1 Journey:

April 13/06 NOA1 from NSC

June 1/06 - Moved to CSC

August 12/06 APPROVED - NOA2!!

August 28/06 Left NVC. . . Vancouver Bound!

September 27/06 Interview APPROVED, with visa in hand

October 29/06 Moving Date

December 30/06 Married!!

AOS Journey:

January 16/07 Sent out AOS, EAD, and AP docs

January 23/07 NOA1's for AOS, EAD and AP

February 13/07 Biometrics in Portland, OR

April 7/07 EAD and AP Received

April 24/07 Interview Scheduled . . . and APPROVED, stamp and all!

May 7/07 Greencard is in my hands!

ROC Journey:

February 17/09 Sent I-751 to CSC

February 18/09 NOA1

March 14/09 Biometrics appt.

April 22/09 Date of Approval!!

June 25/09 Greencard arrives in the mail!

*Everything I post is just my .02 cents, seek a lawyer for anything beyond that.*

Thank you very much together2love! This info is very helpful.

Also, can anyone tell me if you send the entire tax return or just the page with both names on it? My husband is self employed and tax return is a big package?
