hi everyone,i need direction on what to do..my finacee went for her interview on may 2007,and she was given a paper that the CO will do an investigation,..after the home visit by the CO on may 2008,during which the CO met her brother who didn't give them a lot of info on our relationship, she was called back and they gave her a paper that our petition was been sent back to uscis for possible revockation ..on oct 2008 i received a letter from uscis that they have received our petiton back from state dept and are reviewing it,that it will take 6mths.if after then if i haven't heard anthing from them that i should contact them..so what do i do now should i go ahead and get married since my finacee is 6mths pregant and file for k-3 or cr-1? or should i contct my congressman and see what they can do for me?or do we wait till we hear from uscis on what is their final decision..any ideas will help thks.may God BLESS

Sure been a LONG time. Have you made any moves to rectify the situation?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Contact your Congressman explaining the circumstances... you could call USCIS customer service and ask how you might go about speeding up the review process too. I don't know how helpful they'll be but still...If you're okay with marrying and then going through all the motions of a k-3 or cr-1, that could be an option for you too...but personally, I would see if the Congressman or USCIS could tell you anything or help at all FIRST. I imagine it would be faster than having to file a brand new case... Weigh the odds though. It's a tough call... Good luck :)

First of all, it would be really helpful if you filled in your timeline and country of beneficiary. Some people might be better able to answer your questions if they knew what Embassy or Consulate you were and had gone through. I agree about getting your Congressman involved. Your petition has been sent back. Did they say why?

Getting married and refiling will not change their decision unless you've addressed why it was sent back the first time. That needs to be addressed first. Again, so much depends on what else they said in the letter as to the reason it was sent back, and from what country.

What happened between May 2007 and May 2008? Wow, that's a long time to schedule a home visit!

we were never told why our petition was sent back from the embassy at lagos ,i did contact my congressman office while the petition was still at the embassy and she never respnded back t me what she found out...but from may 2007 to may 2008 are case was placed in AP\AR ...but iw ill contact mycongressman office again and see what they can do for me...

The paper that your fiance has. What if anything does it say. Lagos embassy tends to send things back for poor reasons. The previous poster is right that you have to address whatever they returned the petition for.

If her famly member wasn't real talkitive they may have said something about lack of a bonafide relationship. If you two are expecting I take it you have returned to visit and have more pictures. They are actually supposed to respound in 120 days and you are getting close to that.
