Timeline

We submitted our case about a year ago and haven't heard anything since the end of March 08. Now this morning hubby had an email update stating that they've sent an RFE to us. No idea what it's for but it's a little blah that we're going to have to get yet another package together... we just sent out a form to renew his EAD. It feels like this process never ends sometimes.

I know it could be anything but I'm assuming that its to prove our relationship is legit (i have a joint bank account, a lease, and photos..could send more than that) or unfortunately it may have to do with money, which will be more complicated since i left one job in sept and started a new one in dec and hubby is working now too. We make wayyy over the poverty line but just updating all that info is going to be a huge pain.

New RFE paper requested on 2/4/09.

New RFE paper received 2/28/09..gee good thing that RFE isnt due til beginning of April!!!!!!

Send RFE reply 3/3/08

EAD Approval was NOT updated online. We had an infopass meeting for 3/6 and then the EAD shows up in the mail on 3/5!!!! cancelled appointment,

all i have to say is #######.

Hang in there - try not to worry about what the RFE is for until you actually get it. Ours was for something we sent already and simply sent again. Good news is they're working on your case. :thumbs:

Absolutely agreed. An RFE is not the end of the world, and as long as you submit whatever is asked for timely, and your case will progress with no problem. Don't sweat it!

Timeline

The RFE is for the I-693 medical form filled out by a Civil Surgeon. We dont have to return til April so lots of time. When we sent our case in we knew this may come up because when we read the guides here it said "If you are a K-1 fiancé(e) or K-2 dependent who had a medical examination within the past year as required for the nonimmigrant fiancé(e) visa, you only need to submit a vaccination supplement (I-693A), not the entire medical report. You may include the vaccination supplement with your adjustment of status application.)"

We did that, but they'd like the actual I-693 from us. we knew that sometimes people would get RFE'd for that regardless of the guide, so here we are. Now I just have to call around and see who will fill it out without a full medical. Though its been over a year since he got his vaccination supplement so maybe he needs a full medical anyways??

They (USCIS) have your I-693 (it was taken from you at the POE in that 'brown envelope'). The problem (apparently) is; your original medical was more than 1 year old at the time of filing so it is very likely you're going to need the full medical. (It is not likely a CS will complete a I-693 without a medical exam.) :(

It's not a I-693 in your brown envelope. It's the DS-2053 and maybe the worksheets DS3024, DS3025, and DS3026 The I-693 is only a US Civil Surgeon form.

Your medical was within 1 year of when you filed so you did follow the rules, and that's supposed to be okay, even it it takes them a long time to get to your case. But I guess whoever looked at it didn't think it all through and sent the RFE. I too think you probably ought to take the whole medical over at this point. It might be too hard to argue your case. I suppose you could print off their instructions and point out that you followed them and mail that back with the RFE, but it's probably not worth it. Bummer!

yea i think we are just going to schedule a medical and have them fill out I-693 to be safe. I really dont want the case denied over this so we'll just do it. Luckily we're doing fine financially so it will be worth it.

Thanks for all the talks guys! It does suck but i guess we'll get through it like everything else... haha

oh, and yes our POE was JFK.
