Advanced Parole Need Answers ASAP

Timeline

Hello All,

Sorry to post this and sorry if it is a repeat topic but we need some information ASAP.

I was under the impression that the advanced parole document, which we have, is all my wife would need to return back to the USA after going home to visit. We married before her K1 expired, but filed for AOS about 5 weeks after it would have expired.

She is leaving Friday to go to Argentina for 6 weeks. Was she ever here illegally? Is she going to be denied entry? CAN she be denied entry because of this?

We are worried. Please help.

The AP is what allows her to exit and re-enter the country. She was out of status, but it's excused she's got a pending application. The AP shows the IO at the POE that she entered the country legally and is currently waiting for a GC.

Timeline Summary:

K-1/K-2 NOA1 - POE: 9 February - 9 July 2010

Married: 17 July 2010

AOS mailed - Interview : 22 November 2010 - 10 March 2011

ROC mailed - approved: 14 February - 18 June 2013

Citizenship mailed - ceremony: 9 February - 7 June 2017

Timeline

That sounds like a valid concern. Did you contact an immigration attorney (a quick call would probably do) or someone at your nearest Immigration office to see what they say? That is what the Authorization for Parole form suggests if you have any concerns. Good luck!

bring both copies of AP and the marriage certificate too, just in case.. ;)

You are fine in regards to time. She will need to bring with her

-Passport

-Marriage Certificate

-Advanced parole (both copies!)
