Greetings all,

I wonder if someone could help clarify... the Adjustment of Status guide says that if my Fiance had a medical exam at the consulate while obtaining her K1, she *might* need only the immunization form. However, this site (http://www.visajourney.com/forums/index.php?autocom=custom&page=k1k3aos) is the only place we can find that reference -- and the form itself suggests that a particular doctor (recommended by USCIS) must conduct that exam... do we need to submit this information as part of the K1?

After you have been approved for the K-1 Visa then you will need to have the medical exam done. The Consulate will send you a package with Doctors in your area who are the only ones qualified to do the exam. Once your fiance is in the US and you are filing for AOS then you might need a I-693 which is basically just having the documents transferred from your first medical exam to the I-693 form. If you haven't sent in your petition for the K-1 yet, then you are still a ways away from needing the medical. :) Hope that helps.

Yep... she's here, and we're filing... we just don't know how to be sure if (for instance) that the I693 is (or isn't) required...

Well, yes and no... they gave her a full medical exam at CDJ, but did not give her a copy of the form to bring with her... does this mean they have it on record (and so we don't need to repeat)?

Unless you have a copy how do you know it was included in the visa medical?

When did your fiancee have her medical?

The DS3025 vaccination chart should have been included inside the envelope she would have turned in at the POE. They(the docs giving her medical) should have given her a copy of that before she left the office.

My husband had his medical in London on June 30th. They gave him a copy of the DS3025. Because this was around the time period where they were switching the rules for the TB Test and requiring the I-693 form, we didn't send in the I-693. We only sent a copy of his DS3025 with a letter explaining when his medical was, and that everything should have been included in that and we would provide whatever else they needed if it was necessary.

Some people have had luck doing it this way, some get an RFE for it...but we figured why should we spend an outrageous amount of money to have someone copy info from one sheet to another and sign their name if we can try to do it the other way. If we get an RFE, we will comply with what they need.

I've seen a few differing dates as to when the new rules officially went into effect, but I'm thinking if your fiancee had her medical around july/august then you will have to have the TB skin test and also have the I-693 filled in by a USCIS Civil Surgeon. Unfortunately, many CSes will refuse to sign the sheet if they're only doing a transcription from the DS3025 and will insist they perform a full medical even though it's not necessary for K-1.

Wow, thanks for writing with so much detail.

She had her medical in Ciudad Juarez in mid October, but did NOT give her a copy of the forms that were provided to us in a sealed black bag (what everyone there received). At the medical, they did go through her vaccinations and indicate that no more were needed. So as you say, they should be with the materials submitted at POE, and we shouldn't resubmit with our I-485, correct?

The new Tb requirement became effective at the end of July. Your wife will need a Tb skin test, unless you want to chance it and wait for an RFE. Your wife should have received a copy of her vaccination form from C. Juarez. This is the form that would have been included in the K-1 package handed over at the POE. Try to contact the medical clinic that performed that immigration exam and ask if they can fax or mail a copy. If you decide to transcribe the 3025 form to the I-693, thi sinformation will be handy to prove immunization to the CS. But, if you have the information that proved immunization in C. Juarez, that info will also prove immunization and you can submit this evidence to your CS.

It's a gamble to forgo the CS step as no one knows if the Tb skin test is required by K-1 applicants. Your vaccination record should be included in the black k-1 package you submitted, but if i tis missing or USCIS determines that the Tb test is required, you risk an RFE.

I recommend getting your wife's vaccination info from her home country and have a CS fill out the vaccination section as per USCIS instructions on the I-693. A Tb test is around 15 dollars. The CS we found was open to transcribing both vaccination and the Tb skin test results from a medical clinic they told me to go to.
