Hi,

I am applying for an AP and EAD for my wife. I need help with couple of questions.

Advance Parole:

How much do we need to provide in the written explanaiton in section 7 of the form? Does it have to be emergency related or casual answers are fine?

EAD

I am not sure what where to find elgiibility category for a spouse who entered the country as a fiance and has a I485 in process. Any help here is appreciated

Finally - a question that applies to both. My wife entered as a fiance and we subsequently got married. Her fiance visa will expire in a week, but the AOS is in process so we should be fine.

Should we put K1 visa as current status or I485?

Any help on these questions will be much appreicated.

Day 34 - Jan. 13-2011: I-751(ROC) Biometrics Appointment Letter for 1/31/11

Day 46 - Jan. 31-2011: I-751(ROC) Biometrics Completed

Day 138 - Jun. 09-2011: I-751(ROC) Approval Letter Received

Day 1 - Oct. 27 '11: N400 Package Delivered @ Lewisville, TX

Day 5 - Oct. 31 '11: N400 NOA-1

Day 34 - Nov. 28 '11: Email: Placed in line for interview

Day 57 - Dec. 22 '11: Received yellow letter

Day 144 - Mar. 17 '12: Received fingerprinting letter

Day 147 - Mar. 20 '12: Biometrics completed

Day 156 - Mar. 29 '12: Email: Interview scheduled, letter in mail

Day 190 - May. 02 '12: Interview Completed, Passed, Oath same day

Casual and emergency.

Current status can be Pending AOS.

Don't forget copies of your I-485 NOA1 so you don't have to pay.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Note your wife is appying for AOS, EAD and AP.

AP, This is an interim benefit of AOS, so no justification is needed other than to be able to travel home for a visit while AOS is pending.

EAD:

Use code (c )(9 ) BASED on pending I-485, this is the NO FEE EAD.

Include EAD and AP apps with I-485.

Well we applied for EAD, AP and AOS for a flat fee of $1010 since she is here on k1 i think you ll do same. But since your AOS is already in process you just have to file for EAD & AP then send in copies of your I485 NOA. Search Uscis for the current fee for EAD. Meanwhile you dont need to have a reason to file for AP

USCIS.GOV... you ll find current and reliable answers there.

I wrote K1 Visa in mine got no RFE

Oct 15, 2008- Biometric APPT (smooth and quick)

Oct 16, 2008- Case pending ......

Ap approved...approval notice sent 12/03/2008

Ap arrives in mail... dated ..............12/12/2008
