Filed: Timeline

Hi, I had filed for I485 for my wife. The application is under process at CSC. I didn't apply for her advanced parole and EAD with her application. Should I file for these separately.

We are planning to visit our home country (I am a US citizen) in Feb-Mar timeframe (for 3 weeks). Should I file for a separate AP to meet that deadline? Any response will be appreciated.

Yes you can apply for that separately. Make sure you include a copy of your I-485 receipt.

Yes you can apply for that separately. AT NO COST Make sure you include a copy of your I-485 receipt.

Thx JB_VJ - Does I485 include these two (EAD & AP)? I thought they were but now getting conflicting information. Let me know.

No, It does not automatically include the EAD & AP. You can apply for it along with I-485 (like I did) or you can a apply for it separately with a pending I-485 (Send a copy of the I-485 Receipt with AP & EAD Application). If you payed $1010 as your filing fee for I-485, you do not need to send in a payment for EAD & AP, as that filing fee includes I-485, EAD & AP( If you choose to apply for those)

Make sure you do have a good story on your way back, though.. they seem to often (from what I hear from someone I know with close ties to immigration) pick someone with an AP at the border, take them apart and give them some sort of an interview about his trip... they do this because the AP should only be used in emergencies and not for vacations.

Also, keep in mind that as soon as you want to enter the US on a AP, you are officially still applying for admission into the US and you are therefore automatically subject to exclusion... check this link also for info about this: http://www.vkblaw.com/law/depproc.htm ..this basically means that they can easily put you out of the country, even if you are still adjusting for status. Now, this will probably not happen so fast but still, it might be a thing to consider (and especially when you travel outside the US just for a vacation).

12/19/11 - Received by USCIS

12/21/11 - NOA date

12/22/11 - Check cashed

12/27/11 - Received NOA

02/06/12 - Received yellow letter (pre-interview case file review)

03/13/12 - Placed in line for interview scheduling (3 yr anniversary)

03/17/12 - Received interview letter

04/17/12 - Interview - No decision, application under further review

04/17/12 - Biometrics

04/25/12 - Placed in line for oath scheduling (so I'm approved yay!)

04/27/12 - Received oath ceremony date

05/09/12 - Oath ceremony!!
