Wife in US. Need help for further steps.

Timeline

Hello VJers,

My wife and my self finally traveled to US from Kuwait on Dec 08 and cleared all immigration process smoothly.

Thanks to you all for the much needed support and guidance.

I had some follow up questions now.

1. What is the next step? I believe CR1 is a conditional residence. How some can I get rid of the condition. What all forms do I need to file?

2. Can I file joint tax return for this year 2008? Do I need SSN Number to do so? It seems that I need to wait for Green Card to show up before filing for SSN? I have a feeling I did not select the option of automatic SSN assignment, hence have to apply for it my self.

02/07/2008 - I-130 Sent

02/09/2008 - Recieved in Chicago (signed for by R MERCEDO)

02/22/2008 - Check Cashed

02/23/2008 - Received NOA1 in mail. (Notice Date: 02/20/2008)

05/14/2008 - Received NOA2 in mail. (Both 129F and 130 Approved) (Notice Date: 05/08/2008)

09/23/2008 - Application Completed at NVC

11/17/2008 - Date of Interview

Timeline

Yes CR-1 = Conditional Resident Visa.

If you your marriage is less than 2 years old at time of entry on a CR-1 you will get a 2 year conditional green-card.

1) You will file I-751 to remove the conditions within 90 days of the card's expiration, two years after entry to the USA.

2) YES, give SSA about 15 - 30 days after entry, then apply for a SSN if one does not show up in the mail, you will then use the SSN when filing a joint IRS return.

I have query here...My friend got married in April 2007, got her visa in November 2008 and flying next week (POE on 19 december 2008). Which means she is gonne have her 2nd anniversary with in almost 5 months.So, what kind of green card is she going to get against CR-1, is it for 2 years conditional or 10 years? How long does it gonna take for her to apply for citizen after she removes condition 90 days prior to condition expiration date?

They will get 2 Year card, the CR-1 holder would need to wait and enter the USA AFTER 2 years of marriage in April 2009 to get automatic 10 year card.

Entry this month will get the 2 year card.

Thanx buddy...But I read somewhere in this forum that, if the POE in within 6months prior to the 2nd anniversary, they would he getting 10 yrs card..May be I got it wrong...Did I?

You got it wrong, I have read of persons entering 1 day before 2 years of marriage, and they get 2 year conditional card.

The line is drawn at 2 years of marriage at time LPR status is granted (POE Entry) if less than 2 year it is conditional, if more, then it is UN-Conditional. It is a HARD-LINE.

The CR-1 has a 6 month validity time on it it MUST be used within 6 months after it is issued.
