Hi,

A question about filing Affidavit of support (I-864) : USCIS ask about most recent tax year return which is currently for 2005... but we still cannot file 2005 tax because not all my W-2s have arrived... what do we do? list 2002-2004 years or just wait untill we can file for 2005???

I am in the same position, I am waiting and sending 2005, I know if I don't they will ask for them.

You would just include your 2004 return with the I-864 and then bring your 2005 return to your interview. As long as you file for AOS before April 15th, you should be OK.

if you have your w2 and your 2005 tax done can that be sent in in the next couple of weeks with the aos or does it still have to be 2004 till april just wondering thanks

They ask for you to include your most recent tax return, so if you have already filed your 2005 return then I would include that. You may want to include your 2004 return just to be safe, but I think the 2005 return should be sufficient.
