we just received a letter from USCIS (form I-797C) stating that there is an error on the application,...."Invalid Part 2 Application Type Other Basis of Eligibility", in which section we had chosen.....H. Other Basis of eligibility.....I am a spouse to an American citizen. What should i be choosing if that is not the correct basis

Marriage : 2008-11-08

I-130 Sent : 2008-12-02

I-130 NOA1 : 2008-12-18

I-130 NOA I-797 : Approved : 2009-01-12

NVC Package Received - Form DS-3032 : 2009-02-26

FORM DS-3032 : E-mailed response to NVC: 2009-02-26

FORM DS-3032 : Mailed via regular US Mail to NVC : 2009-02-27

------------------------------------------------

I-485 was rejected because of an invalid part 2 applycation type other basis of eligibility.

I-485 Re-Sent:2008-12-19(Thaks to u guys, I could filled the right answer :) )

I-485 : Check cashed on 2009-01-07

What i forgot to mention is that I entered on a visitor visa and not a fiancee visa. I don't know what option would apply to me. Thank you very much for your help. we know 2 other couples that entered as visitors and got married before it expired, and they chose the same option on part 2, with the same explanation. i am really unsure of what i should put, no other option offered applies to me. Thank you again for all your help.

You should have selected A based on an approved I-130 or submitted concurrently with the I-485.

If your spouse filed I-130, Petition for Alien Relative and is being filed concurrently with I-485. In part 2 of I-485, you should answer 'A'. This is only applies if your filing concurrently.

If your spouse filed I-130, Petition for Alien Relative and is being filed concurrently with I-485. In part 2 of I-485, you should answer 'A'. This is only applies if your filing concurrently.

No. You may file I-130 and some time later file I-485 (you must receive NOA1 for your I-130) but still the correct answer is 'A'. Been there done that :)
