Timeline

Husband= Petitioner Me= Benificary

My husband last filed taxes in 2005 when he was in the military, He has been working with his dad since and is paid in cash.... I guess my questions are

1.What do we put on I-864 and is there a way for him to file taxes for the past 3 yrs?

2. Is there a way that we can file joint taxes in 2009?

07.28.07---------- Met Mr Jeffs

07.28.08 --------- Married Mr Jeffs

11.13.08 --------- Mailed AOS to Chicago

12.01.08 --------- Checks Cashed

12.08.08 --------- Received NOA1

12.11.08 --------- Received Biometrics

12.12.08 --------- Bio done

03.27.09 --------- Received EAD and AP

04.07.09 --------- Received Interview Letter

05.19.09 --------- Interview

05.21.09 --------- Card Production Ordered

05.26.09 --------- Welcome Letter Received

Timeline

1) Being paid in CASH is not a reason to NOT file returns, file them late. Past year's return (2007) is a requirement of the I-864. The returns can be filed late. Will be subject to interest and penalties if income was in the USA.

2) Yes, if you are K-1 and it has been less than 76 days since entry, apply for a SSN, if not, IRS will issue an ITIN that you can use to file a joint return. http://www.irs.gov/individuals/article/0,,id=96287,00.html

I'd speculate that your husband and his father, both of them, will have issues with the IRS and SSA, also the state. Yes, there is a way to file back taxes but penalties & interest will apply. As to his father as employer, it could be a can of worms. Best get a CPA quickly.

Not really a can of worms on the father - same on the penalties and interest. He can back file 1099's and it will be up to the son to pay the back owed federal, social security and medicare and state withholding. This IS all assuming we are talking about the US and IRS.

Not a CPA, but I play one in everyday life. (Full-charge bkkpr)
