Hi everyone I haven't posted in a year but i'm back . Well due to the fact my aos papers got held up in the mail they were returned a few months later with a denial due to the new fees.We are down to the last few months and we need to send this all in visa expires march 18th 09. Hubby and I just bought a house in july so things are tight for the moment but our total fees for this is now 2850.00 as a k3/4 me and 2 kids plus we need to do their I130's with this.Will it make it harder if I just file for myself and save money for their fileing. i could really use some help on this.Any advice would be great thank you all.

dependent on the age of the kids it could be just more expensive.

The harder will be logistical items such as travel limitations

You could do that $1010 now for K-3 AOS, but keep in mind the fees for children may also become $1010 each if filed separately.

Not filing with the I-485 application of at least one parent have a fee total of $930

The high cost of AOS is one of the reasons I tell people considering K-3 visas to just stick it out and do the CR-1 visa, the extra month or so that CR-1 takes more than offsets the pain of AOS.

K-3 is a multi entry visa and is valid for entry/re-entry until the expire date... you should have no issues traveling as long as the CBP understands the rules

You could do that $1010 now for K-3 AOS, but keep in mind the fees for children may also become $1010 each if filed separately.

or just $930 each if under the age of 14

Not at all, K-3 and K-4 are Multi entry visas they are designed that way to allow travel.

However, dont attempt this after it expires and AOS pending, doing so can cause USCIS to consider the AOS ot be abandoned.

You can apply for an extension of the K-3 by filing I-539.

Filing Fee :

$300

Special Instructions :

K-3/4 Nonimmigrants:

Use this form to obtain an extension of K-3/4 status while your permanent residence case is being processed. You may also submit a Form I-765, Application for Employment Authorization, at the same time as this form to request renewal of your employment authorization. You may travel outside of the United States and be readmitted as a K-3/4, if you have a valid passport and K-3/4 visa.

My dad had heart surgury so I went back home to be with my mom thankfully that all went well but I tell you I was freaking out in the car at 4 am to go get my train I never had problems before they really need to get the border people better informed on this.

One other note and FEE. More than likely you will have to do a FULL I-693 for each person adjusting status due to the medicals for the K-Visas being more than a year ago.

Only positive I can see is that you wont get Conditional Green-cards, the resulting cards will be 10 year un-conditional ones due to marriage being more than 2 years old.
