How do 'they' know if it's a CR-1??

Timeline

So, we're going the CR-1 route, onboard with the I-130 and all but my question is this...

How does the Visa center ultimately know that you're applying for a CR-1 visa when all t he visa processes start with the I 130?

Is it based on the steps you take?

Do you tell t hem at some point which Visa you want? Do they figure it about by the steps you complete or the steps you don't?

In our I-130 cover letter, should we tell t hem that the Cr-1 is ultimate visa goal?

Interview Assigned - December 3, 2009 - FINALLY!!

Medical - December 14, 2009 - Passed

Embassy/Interview - January 26, 2010 Montreal, Quebec Canada - 167 days PASSED!!!

Port of Entry - February 26, 2010 Baltimore International, Maryland

USCIS -- ROC package sent off

November 26, 2011 to Vermont station November 30, 2011 received NOA1December 16, 2011 received biometrics appointment.

January 04, 2012 Biometrics

September 2, 2012, RFE Received.

September 22, 2012 RFE responded to

October 15, 2012 ROC approved, 10 Green card on its way.

I-130 visas are family based visas...when you fill out the form they ask you who are you petitioning for...if the answer is husband/wife then they know it is either a CR1 or IR1...the difference between those two is that a CR1 is a conditional relative visa and are for those who are married less than two years and they will know that by looking at your marriage certificate...an IR1 is an immediate relative visa and those are for people who have been married for over two years...again looking at the marriage certificate will determine that since it shows when you got married.....

05.12.2008: DS230 Entered into System

06.18.2008: Case Complete (So upset that it took this long 37days)

US Embassy:

10.29.2008: Interview Date Assigned

11.17.2008: Medical Appointment

12.03.2008: Interview Date (FINALLY!!!)**APPROVED**

12.08.2008: Visa Delivered

12.21.2008: POE JFK

They do determine which visa you are applying for based on the forms you submit and how certain questions are answered. As stated above, an I-130 is a family based visa petiton, so they automatically know that the goal is permanent residence. They determine the type of visa to processed based on the family relation and where the alien relative resides (within or outside of the US). But based on the fact that your I-130 will indicate that the alien relative is a spouse who resides outside of the US, they will process it as a CR-1/IR-1 visa once approved (unless an I-129f soon follows), as this is the only class you would qualify for.
