well in simple words

129F or k-1 is the visa petition filed by a us citizen(only) to bring her/his fiancee to USA. so they could get married inside the USA.

I-130 is the petition filed by either US citizen or US legal permanent residant to bring his/her spouse to stay togather. remmember the spouse means you are already legaly married in or out of usa.

Meeting Online: Yahoo chartroom Aug 2001.

Direct meeting & marriage: Dec 2003 USA, NY

I-130 petition in DCFR Tokyo: March 14th 2004. Case reffered to DHS USCIS

Four visits to japan in 2004: Oct 2004, wife got pragnant.

Wife/Fiance left USA and moved into Japan: Feb 5th 2005.

Baby Born: June 24th 2005(Japan)

I-130 denied: July 17 2005(Divorce was declared not valid)

Refiling Divorce: oJuly 17th 2005 NY State.

Divorce granted: Nov 17th 2005

K-1 application: Mar 1st 2006

Approval: May 23rd 2006

US consulate RFE: June 15th 2006

FRE sent (Original passports, birth certificate, all origional docs): July 10th 2006

Medical: Oct 11th 2006.

Interview: Nov 10th 2006(expected)

129f is also used by married couples that have already filed the I130. Sometimes the 129f is approved faster than the I130 and when used this way, it is called the K3.

I was grateful for the K3 because our I130 took 17 months to clear the cornfields of Nebraska. The 129f sailed thru Missouri in 6 months.

They are very helpful & will help you to understand....................as people have said I-130 is petition for already married , I-129F is Fiance petition K1, BUT also is used for K3 married!!!

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

Feb 2008 lift conditions <<<reminder to self!!<<<< went to England for a visit instead, no rush right, 90 days is a long time,LOL

Removing Conditions Begins

signed for @ NSC April 16th

NOA date April 16th

Conditional GC expired May 5th 2008

Well, I got this message from the case status online site.

Does the application type would show the type of form you're using or what? Does this mean that my bf didn't apply for K1 but instead applied for what? We're not yet married but we're planning to as soon as i get to the US.

I just don't understand..

Sounds to me like all that you're seeing is verification that they received it. That doesn't really mean that anyone has LOOKED at it.

I have no idea what your fiance has filed for. Even the K3 (spousal visa) begins with sending in an I 129F. The I 130 asks right at the outset if you are applying for a husband/wife, parent, brother/sister or child. So what was his thinking in sending in the I 130 for his wife if he's not married yet? :unsure:

Why not ask your boyfriend for confirmation of what form he filed?

An I-130 is for Immediate Relatives: spouse, parent, child.

"Hi if you are married we want you to file an I-130, but to speed things up, after you send us that worthless petition you can file an I-129f which will be much faster. We could just allow you to file it immediately since you are going to use it anyways, but we reserve that right for people who are only engaged, but if we did anything else it would make sense."

Well, it's not *quite* that dumb, but not far.

When the K-3 was created a few years ago, the state of I-130 processing was an absolute nightmare. 3 year waits for just the I-130 were not at all uncommon; a wait of over one year for the petition was the norm. Faced with that kind of wait, a 6 month turnaround on the I-129f seemed like a dream.

Then INS made a commitment to adjudicating petitions within 6 months and things improved a lot. In fact, so much attention was given to clearing out the backlog of I-130s that the follow up I-129fs for K-3 just sat there and for a while, no one even pursued a K-3.

Now, none of it makes anyone happy.

well, he did send an I-129F form. he even sent a copy to me. that's why i asked him to call the center to verify his application. otherwise, we'll have to wait. i just wonder what kind of application type is written when someone is applying for the K1 (I-129f) visa, will it show a different message than what I had received on the case status online?

If an I-129F gets filed, the on-line status says so. It does not say that you've filed an I-130.

If your fiance filed an I-129F, then it seems as if USCIS has incorrectly entered data into their computer database. Your fiance should call the USCIS help line to get this corrected.
