Hi, Finally i received my us citizenship and i want to file for my parents to come here. which form should i file i-130 or IR5. How long does it take and which one is faster. Any help is very appreciated. Thanks

You have to file the I-130 for each parent and once that is approved they are then sent the application for a immigrant visa (IR-5). So there is no choice in what to file. The process is the same as for a CR1/IR1 so have a look at the flow chart for that visa and it will give you an good idea of what you will need to do at each step of the way.

It can take anything from 8 -12+ months for them to get their visa and be ready to enter the US.

An I-130 is a petition

An IR-5 is a visa

The USC petitions to determine eligibility for an alien to apply for an immigrant visa.... Once approved, the immigrant will then apply for a visa.

they have 10 year visitor visa right now, does it make any difference. Can we apply when they come to visit here next summer and while they are in usa.

You can petition for them at any time.... However, if they enter on a non-immigrant visa (ie..a tourist visa) with the intent to remain and thus to circumvent immigration law, is a problem. It would be a HUGE problem if there was an active I-130 petition when they last entered and tried to remain, which probably would be difficult to overcome

If they enter the US on a Tourist visa and intend to remain and try to file for AOS they will be comitting visa fraud and could be deported and banned from the US for 10 years or life.

Do not go this route file the I-130 and have them do things the right way.

Your parents can come visit any time as long as they don't stay living in the US with the INTENT of filing an I-130 and Adjust Status. The right way to do it is to file whenever you want and not stay living here until they receive their IR5 visas.

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview
