though of course it says in our GC that we can file to lift our condition 3 months prior to the expiration date which answers my question lol, but i've heard a lot of options which i want to clarify before i can start the process. i'll be exactly two years here in the states this coming january 2009... by that being said, does that mean i can already file to lift my condition of residency? even though that my 2 yr GC will expire in july 2009? i want to do this as early as i can, "if possible" coz we might be staying in my home country this coming march-may (God willing). im not sure how long the average process would take since my time frame from january to march is not a lot to file and acquire my 10 yr GC before leaving :wacko: , and or if i do file in may, that would mean close to my expiration date also... HELP! need some bright light! :help:

The only time that counts is the time since the permanent residence was approved. It doesn't matter how long you have been in the US.

You can file up to 90 days before the expiration of your 2 yr conditional residence and no sooner.

First of all - you can file "No sooner than 90 Days (not 3 months) before the expiration of your 2-year GC." Secondly - whatever 'options' you've heard about counting your time in the country as time being a permanent resident are very incorrect. Your time starts on the "Date Issued" on your card - no sooner, no later. Nice try though..

You will be able to petition to lift conditions some time in May 2009 and it could take several months. If the process takes you past your expiration date, you can obtain an extension.

This is just one of the unfortunate issue for those with conditional status. They need to plan their lives around removing those conditions.

Fortunately, we knew that such adjustments might be required. Since we had similar plans to spend quite a bit of time in China during the time frame we would need to be removing conditions, as K3, we exercised our option to file late enough so that my wife and daughter received 10 year cards instead of conditional ones. This option doesn't really work for K1 folks.

Facts are cheap...knowing how to use them is precious...
