AM Presently residing in UK and is now engaged to a green card holder of the USA i would like advise on how to go about obtaining the required documents to make this move possible. I WANT to move to the USA with him :help:

You need to have your fiance file form I-129f for you. You should deff check out the guides that are provided on this forum. Go to the "guides" tab and then click on the fiance (K1) guide and the process is layed out step by step for you.

10/10/09 - Mailed both I-130 applications

10/13/09 - Received at Chicago Lockbox

10/20/09 - NOA1 Issued

10/21/09 - Checks Cashed

10/26/09 - NOA1 Received

02/19/10 - Approved - email notice

02/22/10 - Received at NVC

02/23/10 - Assigned Case Numbers for both applications

02/23/10 - Registered email addresses with case numbers

02/24/10 - Received emails for AOS Bill $70 & DS 3032 Choice of Agent form

A legal permanent resident can not file a fiance petition, only a USC can do so.

You can either wait until your fiance becomes a U.S. citizen and file for a K1 fiance visa, or you can get married, and try to do it that way. I think the process is pretty lengthy for a permanent resident to bring over a spouse.

As a LPR one is not able to petition for a fiance.....that is only available to USC

LPR's can file a petition for a spouse. Therefore you must be married prior to filing.

Have a read in the Guides section on K-3 and CR-1, at the top of the page.

I think the process is pretty lengthy for a permanent resident to bring over a spouse.

VSC is currently processing petitions with a receipt date of Oct 2005 for permanent residents filing 1-130 for spouse.

If you are a lawful permanent resident and your petition for your spouse is approved, your spouse will be notified by the Department of State when a visa number becomes available.

Be careful with the green card holder applying for your immigrant visa (family based.) Last week I checked and saw that the waiting time for a spouse for most countries was 5 years. If he gets his citizenship (after 5 years of residency) then he can do a K1 or a K3 depending on your marrital status at that time. A K1 or K3 can take a few months (3 to 6 months generally) where as an LPR petitioning is taking years and no guarantee if the dates are pushed back or not. Best bet - have him talk to an immigration attorney and then decide which route he should follow. Good Luck

Talking to an immigration attorney is not going to get you any better advice than you received in the posts here. Either get married now and file the I-130, or wait until he becomes a citizen and file the I-129F. Of course, you could get married now, file the I-130, and if you are still waiting when he becomes a citizen, then I think he can file again and get precedence because he is now a citizen.
