i think ill be stuck at NVC for 2 months or so..

i saw my hubby's tax return from turbo tax and it says that he filed married jointly even if i got denied of ITIN..

Sorry, to tell you, but the IRS won't allow it..they will change it there.

But I think you bigger issue is the tardiness of him filing.

HUH was this necessary??? :bonk:

I am not a CPa, but if your goal is to speed through NVC so you can get the the U.S., my advice is to have him file his returns, married filing seperate and send it off ASAP. Have him get his tax returns direct deposit to his bank account, and wait for teh 1040A to be sent back my the IRS..then he can send that to NVC to join with his AOS and you should be on your way then.

the tardiness of him filing his tax retursn, si what I mean. The IRS does not like tardiness with tax filings.

Take not offense to that; I would just not like to see you have to pay more to the IRS, because the tax returns are late.

yes, once you have either a SSN or an ITIN then ...yes, her can file joint.

But for you current issue. You must decide what is more important...

1)filing seperately..which he can do now and send the 1040A off immediately...

or..

2)filing joint..which he will need to wait for the ITIN and then have your signature on teh 1040A and you providing proof of your income in the Philippines so that income can be taxed as well.

you must decide what is most important. Yes, if you file joint you may be entitled to a larger income(depending upon that amount of YOUR income ot be added) or the speed by which to process the IRS and get to finish at NVC.

Those, basically are your options.

but on the other thread i post the same, one said he can file my w7 and his tax at the same time..and IRS will send him my ITIN later...

again we did this and they did not accept, two times we tried and were delayed so i wouldnt bother at this time for the delay...and if file married jointly they will just automatically correct the report to show seperate and change the money return to less.....

oooo okay, i misunderstood..hehe

i think i will just tell him to really file it separately..

When he file for Federal Tax, he can include W7 forms along with supporting data, and send both W7 form and 1040(A/EZ) to ITIN department.

ITIN department will process ITIN number application, then write down new ITIN number in appropriate field in 1040(A/EZ) form.

After this process, ITIN department will send 1040(A/EZ) for appropriate department for processing.

I think that is a good choice, but have him go ahead and process for the ITIN..so, that for THIS tax year, he can then file joint and get those extra deductions that are oh so nice.

this is how i understand it, he can file his tax(joint or separate?) with the w7 then, ITIN will be process first before the process of his tax?

Timeline

This might not be much help but I knew they wanted 3 years of tax returns. I elected to use the printed versions ordered on the phone from the IRS. They came as simple printouts, but I think they trust more than copies of your tax return or even official copies from a CPA. I can't remember how long it took to receive them, probably several weeks. I don't know the phone number. My last set of documents were sent in the beginning of Sept and processed from Oct 2 - Oct 9th. Our case is completed as of Oct 9 and waiting for interview date. It's been a very long process. I sent my first I130 in Aug-Sept 2007.

I cannot speak abou the processing of the ITIN, but I do know for a fact that he cannot file joint without the ITIN.

Moonhunt may have been through the process before and have a better handle of the processing of an ITIN.

well, sad to say but we called NVC and they told that my hubby really needs to file his tax for 2007..

so he is sending me paperwork to fill up to get my ITIN so he can file his tax including me,married filing jointly..

but i read that it will take 4-6 weeks to process the ITIN, and thats the time he can file his tax and then after filing, thats the time he can send the AOS to NVC..

all in all, it will eat almost 2 or so so months before my case be completed..

my question is, is there any other way we could do?any other options?

if i could get an interview even if he have not send the AOS yet?

or can he get a co-sponsor if he has no 2007 tax?

im so upset..

he didnt file late..

not saying he file late, and im sure he did get both but you go back and ck or ask irs and you will prob see they amended the return within the system to not show jointly and he prob would have gotten letters explaining this at the time

I filed head of household last year and then realized (after sending in the 1-130) and researching that since I was actually married last year (December) that I should have filed married. I decided to do the right thing and ammended my tax return from head of household to married filing jointly. I sent the ammendment to the Austinn, Texas center along with my application for my husband's tax identification number. He lives in Nicaragua, has a job, but has never paid any USA taxes (there is no reason to--he doesn't live here and isn't a US citizen). We ended up receiving $4000 more in a refund simply because I was filing married.

My advice--file at the center where they will give you a tax identification number. You can get all the info on-line.
