Ok, lets see if anybody here knows what to do. nobody at the immigration office had a clue.

My wife and step daughter are here on k3-k4 visas.

My Wife is already working since we got the EAD before we did the AOS.(because we where not

sure if we were going to stay in the usa or not).

Now we are doing AOS and I need my wife as a joint sponsor. She is already working and she

is also an intending immigrant.

It says I need one I-864 for each person. so what do I do ? one set of I-864a were my wife

is joint sponsor for her self and one were she is joint sponsopr for her self and her daughter ?

I mean .. it says on the i-864 instructions that I should not include the other people on the same

petition that I am doing a separate petition for..

Looks like this situation has never happened before.. anybody has a clue what to do ?

I take it you don't qualify without using your wife's income. If so, yes you'll need two sets of financial documents. I-864 and I-864a for wife and again for daughter. If you qualify with your own income, you can skip the I-864a's.

The guidance states that a sponsored immigrant’s income may be used toward meeting the sponsor’s income requirement if the immigrant has been living in the sponsor’s residence for at least six months prior to the adjustment interview. The sponsored immigrant should not complete Form I-864A in this case because it is presumed that he or she will support him or herself. However, if there is a spouse and/or child immigrating with the sponsored immigrant, the sponsored immigrant must complete Form I-864A in order to have his or her income counted.

totally confusing ... but that might answers the question ... i hope :unsure:

hmm

so it's says one one hand "you need to complete this form only if you have

accompanying dependents" And as they say I am to file these afaidavits individually

with no mentioning of the other family member since they have a separate petition.

They way I understand it is to file only one i864a that is going to be attached to the i-864

petition for my daughter. The one for my wife I have to check 24 e and say I that I need no 864a

and that she has no accompaning dependents (even though she has , but the daughter is on a separate

petition) ?

well , thanks for your answers.

I think maybe when they make it so confusing that the immigration officers themselfs don't understand it , I'm

just going to do it the way I understand it and submit proof of income from both me and my wife. But the forms

are very inconsistent , that is for sure
