Timeline

I'm in the US on a K-1 and we are now officially married. Unfortunately, my K-1 has expired and I still have nothing back from the INS even though all of the paperwork has been filed (now that we are married) to proceed in the process. I want to travel within the US but because of where we live (in Texas near the Mexican border) I know we will go through an INS checkpoint (it's right up the highway) and they might ask for my papers and all I have is an expired K-1. Has anyone been stopped within the US with an expired K-! and if so, what did they say or do about it?

You must live near Del Rio or somewhere like that...

Unfortunately you will need to be able to have something to show your "pending adjustment of status" to the immigration officers at those checkpoints if they ask. Do you at least have an NOA1 from your I485 application? It might be advisable to carry a copy with you and be prepared to explain your situation every time you cross through. Those border checkpoints are a pain in the a$$ (although it's good, honest, drinky fun to run through the dirt road in your sock feet after they drag it to see if you can get the lazy, usually obese border patrolmen to try to track you)

I've been through a few of those myself near Big Bend. They just would notice my US licence plate and that I wasn't Hispanic and let me through without any questions. But yeah if you don't have a US drivers licence then you might need to show something else to them...

Aug - Filed for AOS

Sep - Recieved EAD

Sep - Recieved Advanced Parole

2004

Jan - Interview, accepted for Green Card

Feb - Green Card Arrived in mail

2005

Oct - I-751 sent off

2006

Jan - 10 year Green Card accepted

Mar - 10 year Green Card arrived

Oct - Filed N-400 for Naturalization

Nov - Biometrics done

Nov - Just recieved Naturalization Interview date for Jan.

2007

Jan - Naturalization Interview Completed

Feb - Oath Letter recieved

Feb - Oath Ceremony

Feb 21 - Finally a US CITIZEN (yay)

Yes unfortunately the OP cannot get a license in Tx without at a minimum an EAD card. They occasionally and just for fun check all the vehicle occupants (randomly) which is why I think it would be best to have a story prepared.

Being stuck between the mexican border and the checkpoint waiting on AOS would suck. I admit sympathy for the OP
