Hi VJ members...I'm utterly confused! Here I thought the K-1 Visa process was difficult...this is crazy! Anyhow, my fiance arrived on August 28 and he was able to get a Temp EAD which will expire on 11/26. We will have our civil ceremony on 11/7 and the goal is to get a copy of our certificate asap.

I'm confused and any help from the VJ family will be greatly appreciated!

These are my questions:

1) While applying for AOS, we will need to apply for a permanent EAD. Does this mean that he cannot work until he gets the permanent EAD? How long does this take? Is there any way that I can expedite the EAD? He finally got a job and will be starting on Monday. Can I do that right now or does this defeat the purpose?

2) They required a translated version of his Birth Certificate. His is in Italian, how do I go about getting one translated? Or any advice on where to go or how some of you have done it.

Any help you provide is greatly appreciated!

The temp EAD will expire the same day his I-94 expires ... 90 days from entry. Therefore he will not have authorization from the DHS to work between the time when his temp expires and as he awaits his EAD that you apply for AOS. Every employer is different in their interpretation of the law.. there is much confusion even here on VJ in regards to this. This is one of the reasons many POE's have stopped giving them out. You can find the EAD timelines in the links above. Same way you search for other VJ timelines. I think it's taking 2-3 months to get right now. I've heard of people calling their local service center to have it expedited.

Someone fluent in both languages can translate the document and certify that they have done it. There is an example here on VJ.

1) He cannot work during a period when he does not have EAD which he now has until 11/26, 60-90 days typical, No.. requires marriage & I-485 application for the 1 year EAD

2) Can be done by anyone who is competant in both languages... If you or he qualifies you can do it yourself... Google can help you as well as a University's language department

We ordered International Birth Certificates from Germany (they're pre-translated into MANY languages) - it's possible/probable Italy has this too. :thumbs:
