Take deep breaths because my blood is boiling!!

I filed the I-90 with reason "D" (USCIS error) and they received my greencard and application back on Feb 20, 2008, thankfully I have the mail receipt notice to prove it. They had approved the removal of my conditions but sent a card that had sex ="M" which was clearly an error on their behalf, ha!

So after my 180 days wait and no replacment green card, I placed a call to the information line to file an inquiry. The lady said my case would be assigned to an immigration officer by Sept 20, 2008. That date came and went and I called back. This time the gentleman told me quote "We tell people it could take 1 month but usually its more like a couple months so call back and place a 2nd inquiry in 2 months!" which would make 9+ months that would have elapsed with no greencard.

Well, today I receive a letter in the mail from USCIS that states "We are sorry but we can not offer you any assistance at this time, based on the information you gave us. No I-90 receipt was found for the Alien Number you gave us. The applications and fees for I-90 applications are collected and processed by the Los Angeles Lockbox. You may contact them through the email address: Lockboxsupport@dhs.gov". WTH!@$ My I-90 application, as per the directions was submitted to Laguna Niguel, CA.

So, I'm assuming from the above they've lost my I-90 application?? Its been over 8 months of dealing with this, what should I do next? I guess I'll make an info pass appointment and drive the 2 hours to talk face to face with an immigration officer at my local office?

Thank God, I have copies of practically everything I sent them and everything I've received including a photocopy of the greencard that had the mistake on it. Do you think my local office can get this mess straightened out without having to re-file another I-90 and waiting another 8 months. This is so depressing :crying:

I can understand how you feel it took them 6 months to spell my last name properly.

If I can read your timeline properly looks like you can apply for Naturalization in November, maybe you can get the Naturalization certificate, if you do not have the GC by then you can add a copy of your i-90 aplication and any proof that you paid for it.

Hi JamieandTrevor,

Sorry that you had to go through all that trouble in sending in your I-90, only to have them lose your I-90 application after such a long time.

In regards to the gender error on your green card, in my opinion, I don't think it would cause much of a problem, as it is not a major error. It is not worth changing and/or refiling, as that would take too long and be more inconvenient for you to do so. The only reason I can think of that it would cause problems is if you use your green card a lot for travelling and that is your only form of ID that you have. If you have other ID when travelling, such as national/state US ID, a passport and/or a birth certificate, or other foreign ID, that states what your gender is, then you can show that too, along with your green card with the error on it, and hopefully it shouldn't cause a lot of problems.

Heck, when you encounter an immigration official, they can see your photo on the green card and see you directly in-person to know what your correct gender is, based on appearance alone, so they definitely shouldn't question that (and maybe they'll see the humour in the mistake too)!

For humour's sake, you should just keep the card, just to show how simple "gender mistakes" the USCIS can make at times. Lol... :lol:

Besides, if you do go for citizenship soon, realize then that you'll have to surrender/give back this 10yr card in order to get your citizenchip certificate. So if you don't want to worry about it now, you can keep it until citizenship, and give back this card with errors on it then (and then finally laugh about this mistake then when you don't have to worry about it anymore).

Nevertheless, if you are still bothered by this error, by all means, you can re-file the I-90, and hope that they get it correctly and on-time fixed for you.

Whatever way you choose to fix your green card error, I wish you the best. And good luck too, on the rest of your immigration journey!

every case are different. can't exactly help you in anyway but i can share what i went through.i think your evidences are ok. just send everything that you think can help your case. btw, are you divorced already or about to file? because in order to file the waiver, you have to have the decree..best of luck.

I thought an I-90 was for a replacement card if you lost it? Do you have to file an I-90 and pay for a replacement card for something that is their mistake? If that is the case, I bet there are a lot of mistakes.

Unfortunately, if the I-90 is filed based on a typographical error by USCIS the instructions say that you have to return the greencard with the error on it so I did just that.

As it stands, I do not have a valid green card in my possession. That is my biggest concern at this point. I cannot refile another I-90 because I do not have the greencard to include with the application, they have it!

I'm certain that I can not apply to naturalize either because they will want to see my greencard as proof to be eligible to take the oral test. This has been a bloody nightmare.

I do have an info pass appointment on Friday at my local office to see what they have to say. At minimum, I hope that I can get the I-551 stamp in my passport until I can get this mess straightned out.

Is that the case for typo error? They take your card? For name change, I paid the fee but along the process, I kept the GC with me. I never sent them along with my application. They just looked at it and made the changes at my Bio appointment.

Hi Jamie&Trevor,

No, it's not true that you cannot apply for naturalization, just because they have your green card for the I-90. In fact, it states the following, based on the USCIS wesbite:

All Applicants for Naturalization must send the following items with their N-400 application:

1. A photocopy of both sides of your Permanent Resident Card (formerly known as the Alien Registration Card or "Green Card"). If you have lost the card, submit a photocopy of the receipt for your Form I-90, "Application to Replace Permanent Resident Card"

This would be nice but I was told by 3 different people, during 3 different calls to USCIS that I-90's with reason "D" do not receive a receipt notice. I never did receive one. I sure wish I had a receipt notice, they give them out for just about everything else you do...

Hi JamieandTrevor,

Did you ever make a copy of your I-90 and/or your 10yr error green card before you sent it in? Did you send it by some sort of trackable postal method, to show proof that you sent it in? Did you get a mailer paper with your 10yr error green card, to show that you had a 10yr card mailed to you? Is there any other evidence that you have to prove that you sent the I-90 in too? As well, maybe you can submit that "redirection" letter (saying that they lost your application), to show that they had some action on your I-90 case?

Think of anything and everything that you have paperwork-wise, that you had your 10yr card and that you sent in the I-90 for it, and make copies of all that paperwork for the N-400 if you apply for such. Also include an explaination as to your situation too. And who knows, maybe all that paperwork that you have may be sufficient enough for the N-400....

"Think outside the box," in terms of paperwork proof!

Frankly, you should not have to suffer more for the N-400, just because of a "minor error" on their part on your 10yr green card! It doesn't seem fair at all....

This would be nice but I was told by 3 different people, during 3 different calls to USCIS that I-90's with reason "D" do not receive a receipt notice. I never did receive one. I sure wish I had a receipt notice, they give them out for just about everything else you do...

Thank you, I don't think we should either. I already missed my sister-in-laws wedding 3 weeks ago because of this which I really wanted to attend.

I have the mailer the 10 yr green card came in, I have the Postal Delivery confirmation stamped by USCIS as being delivered Feb 20th and I took photocopies of the card with the error on it before I returned it with my application. They only thing I regretfully didn't copy was the actual I-90 because it was so simple to complete, I thought that I wouldn't need it and now look where I'm at.

I'm going to be certain at my appointment on Friday to ask about not only the missing I-90 but applying for Naturalization with the situation that I currently am in. Perhaps the I-551 stamp in my passport (if I get one) will serve as enough proof that I am eligible to apply for the N400. Frankly, I never want to deal with these folks again if I can help it.

Hi Jamie&Trevor,

Sorry that you had to miss your Sister-In-Law's wedding because of your green card situation. No wonder you are upset at the situation too. Hopefully, as soon as you get this sorted out, you can visit your Sister-In-Law and celebrate with her later on, even though it won't be the same as going to the actual wedding.

In terms of the N-400 for naturalization, that's good to hear that you still have the following, which you can submit:

-Mailer the 10yr card came in

-A photocopy of the 10yr green card with the error on it (good thing you photocopied that before!)

-The postal delivery confirmation from the USCIS for your I-90

-The letter/note saying that they lost/transferred your I-90 to the other lockbox

Which should be sufficient for the N-400, in my opinion, as one only needs a photocopy of the 10yr green card (despite if it has an error on it or not) for this application, as I quoted to you before. Don't worry about the I-90 form that you sent and didn't make a copy of, as you can't give them that if they asked for it since you don't have it now.

As well, you might want to include a note/statement explaining your situation with the I-90 (heck, throw in fact that you had to miss your sister-in-law's wedding), for the N-400, which might help too.

Again, good luck with your infopass appointment this week, to get it sorted out and perhaps get an I-551 stamp just in case. As far as I know, nowhere on the N-400 does it state that while the I-90 is processing that one cannot apply for citizenship. As long as you meet the other requirements stated there for citizenship, you're good to apply there. And yes, you should confirm the naturalization requirements with the USCIS, just in case.

And who knows, maybe along the way, you'll get your error-free 10yr green card in time too!

By the way, naturalization/filing the N-400 is the last step in having to deal with the USCIS. After that, you're "free" from the "immigration process" (unless, there are other issues/problems later on)...
