Hello guys / gals!

Does anyone know what happens to the I-94 during re-entry to the US with using the AP.

I am guessing that my wife's expired I-94 with K1 stamp will be taken by the airline ticketing agent before departure and she will need to fill up a new I-94 during arrival at POE and present that to Immigration.

Does anyone know what type of designation will that I-94 have is my question. Or does she even need to fill up an I-94?

I have read many topics regarding on how to aquire AP (Travel Document) however, there are some that fear using AP because of the possibility of not being able to return back into the US while AOS is pending.

I'm trying to convince my wife to visit her home because it has been 6 months since she has seen her parents.

She's never taken an international flight by herself before across the pacific. Also, she is somewhat worried what will happen of Immigration gives her a hard time at POE when she returns.

I've assured my wife that the re-entry will be smooth because she has all the documents that is required. :star:

I know that she needs her marriage certificate because the AP is not in her single name (Philippine passport)

If you are worried, just take the current I-94 out of the passport.

Yes, as someone who is not a LPR or a USC will need to prepare a new I-94. Designation not important as that is done by the CBP officer

YMMV

Old I-94 probably will be taken. New one will indicate K-1 or AOS pending and probably be stamped expired.

We did not bother with AP or EAD last year, we filed before they were included as part of cost of AOS. I guesstimated Green-card within 4 months, and our guess was on target. Since then we have been to Canada 3 times using green-card.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Is now a US Citizen immigration completed Jan 12, 2012.

Traveling with AP and the marriage certificate should not be a problem. The old I-94 will probably be removed from the passport by the airline agent and your wife will have to fill in a new I-94 upon returning. As to what the designation on the new I-94 will be, I do not know.
