i am pretty sure my fiancee was denied for lack of ties to home country (south korea). she has only had her current job for a few months, and is planning to quit just before her visit (she didnt say that, but she felt that this is what they thought anyway) and also doesnt have much money and her apt is in her parents' name. also, we hadnt made the decision to go ahead w/ the K1 for sure yet, so she said that i was only her boyfriend, not fiancee (and that we had plans for her to return to korea and do the proper process.

i found a similar thread and people seemed pretty sure that this shouldn't have an effect b/c ties to home country don't factor into the K1 decision. can anyone confirm this? and how can I find out the answers to this type of question? is there a statute or something where the decision criteria are explained in detail ?

No affect because she is now applying for the correct visa based on her situation....

The CO will probably ask her about her petition for a tourist visa and all she has to do is be honest, but it won't affect the outcome of her approval of the K1 as long as she brings evidence of you two having a legit relationship.

I was denied a tourist visa to the US just before we petitioned for K1 even though I had got visas to the US before. They just did not feel that I would come back even though we were preparing our I-129f petition. I only had to put that info later in 1 of the forms before my interview and this question was not even asked. Don't worry, these are 2 different visas for entirely different situations. You will now be applying for the correct one for your situation and the tourist visa denial will not matter. Just be honest and tell the truth.
