1 income tax return only?

Hi everyone! How's your day? :) Anyway, I would just like to ask.. would it be a problem if my fiance only has 1 income tax return (year 2005)? You see, he lived his 21 years here in the Phils. and he went to states just last year. He is an american citizen by birth. If he makes $35-40k a year and only has 1 w2, would that be a problem for our AOS? I'm afraid that we will be on AR... :( Any advice? Thanks!

September 5, 2006- POE @ SFO

September 8, 2006- Applied for SSN

SSN arrived more than a month after.. GRRR!!

November 8, 2006- MARRIED @ San Francisco City Hall

November 21, 2006- Received official marriage certificate

Dec. 19, 2006- sent out AOS

Jan. 3, 2007- Cashed cheques for AOS and EAD

March 15, 2007- AOS interview; APPROVED!!

March 23, 2007- Welcome letter/notice received from mail

March 27, 2007- GREENCARD

Sept 5, 2007 - my first anniversary in the U.S

Jan 30, 2009 - Mailed I-751 removal of conditional residence status

Feb 2, 2009 - Package mailed 10:22 AM at Laguna Niguel, CA (CSC)

Feb 5, 2009 - Check cashed

Feb 26, 2009 Biometrics

Prior to going to the USA in 2005, was he working and earning any income while living in the Philippines? If so, as a USC he was possibly required to submit US income tax returns.

If he was required to submit US tax returns and did not, then he may have a problem. If he was not required to submit tax returns, then he simply needs to show a valid reason why tax returns were not required of him. (Note that living and working in the Philippines is not a valid reason.)

And please don't use the acronym AOS if you mean affidavit of support - it causes confusion because AOS if usually associated with adjustment of status. Am I correct that your fiance is still at the visa application stage?

Note that we're dealing with a K visa here. Although the DoS has adopted a similar policy to the USCIS, that policy applies to the I-864 for immigration. It does not necessarily apply to K-visa applications.

If the tax is for Affidavit of support it is enough, they changed the requirements last year and now there is only one tax needed.

There is a Memo about that on USCIS
