Hi Everyone,

I have a question about item#10 in part B on the I-129F form. The item says "Names of Prior Spouses". My fiancee is having her marriage annuled. Should I put her ex-husbands name here or write none. She was married to him for about 10 years and had 2 kids with him. I know in the eyes of the law a marriage that was annuled never happened. I'm thinking maybe I should list his name just so US imigration doesn't think I am trying to hide anything. What do you think. Thanks.

Best to provide his name. Annulment invalidates the marriage. After all, the marriage DID happen and there are two offspring from it. Otherwise, you might be accused of withholding information from the U.S.

I tend to agree with Dominion. But would note that it was annulled.

also, be sure you tick the box in Part C, Q2. Many people miss this and receive RFE's as they think it refers to the military question above. ;)

Yes, list the marriage and provide the anullment papers but you say "is having...". Of course, you'll have to wait until the anullment is complete before filing the petition.
