Timeline

So my I-130 was approved and I received some mail from NVC today; I would like to pay the AOS Fee Payment $70.00 electronically as this seems to be the fastest route.

I have a question though if one of you experts can answer for me please:

If it is the applicant's intention to adjust status with Citizenship and Immigration Services (CIS), please contact the National Visa Center before taking further action or making any payment.

--- What does this mean? What do I want to do? I would like to get my wife here ASAP. Do I really need to call them before taking any further action? Does this indicate that we will AOS after she arrives in the states or do I still have the option to AOS in BKK before she arrives?

Does this mean I have a IR or CR visa or is this K3? I'm still confused..

Did you file an I 129F and get it approved? If so, you can go for the K-3 and adjust status here. If not you are on the IR/CR track. The latter is usually the preferred visa. A spouse might get here a month earlier on a K-3 from Thailand, but dealing with AOS and not being able to work on entry is a pain, not to mention expensive. My DIL has a K-3 visa issued, but now they are waiting to see if she can get

a CR visa! The I-130 was not sent to the NVC. Everyone's situation is different. It would help us to answer your questions if you would kindly fill out a timeline.

It's a general statement, it means if the beneficiary is already in the US and you would adjust status, you need to inform NVC that you do not want to proceed with NVC and consulate processing.

In your case, you can just ignore that particular sentence. :-)

09/30 POE IR1 visa interview took 166 days from the I-130 filing date (expedited).

10/04 Applied for SSN in married name.

11/11 Welcome notice received (dated 11/04)

11/15 Received Green card.

11/21 2nd Welcome notice received (dated 11/13)

11/24 Received SS card in maiden name.

The AOS fee payment for an IR/CR-1 visa refers to the Affidavit of Support, not Adjustment of Status (yeah, nice and confusing!). Adjustment of Status is what it's called when the immigrant comes to the US with a non-immigrant visa (like student visa, or K1 or K3) and then changes to a permanent resident within the US based on marriage. But when you're doing consular processing, there is no Adjustment of Status, so AOS is the Affidavit of Support, the I-864.

Filed I-130 via CSC in Feb 2008. Petition approved June 2008. Consular interview in Mexico, Oct 2008, visa denied, INA 212a6cii. We allege improper application of the law in this case.

2012, started over in Seoul: I-130 filed DCF on 7/2, I-130 approved 8/8, Medical at Yonsei Severance 11/20, IR1 appointment in November 2012.
