ALL ABOUT RECALLED PETITIONS after March 6th

Hi,

I´m a beneficiary, from Brasil and unfotunately, I´m in one of the 20 cases returned by the Consulate in Rio to the USCIS in the USA.

I had my medical done, and my interview scheduled to June 6th.

On May 17th I got a call from the Consulate saying they were told to send my petition and 19 more back to the US immigration.

They couldn´t say anything about it. They only said once they have it back they will contact me with a new interview date.

Since that happened 2 days ago, my whole life changed completely and I haven´t slept trying to get as many information as possible. But it seems to be a USCIS mistake and it´s being quite ard to hear anything useful from them.

Anyways, I think it will be important to all of us to share anything we find out about the recalled cases and all the cases submitted after March 6th.

I might skip a few phone calls I made or put some information out of order since I have been researching like crazy and am a bit lost with all this.

It´s very important to me to hear from you as well since I´m totally desperate with the lack of information.

I gave up work, sold furniture, made wedding plans and have my fiancée crying all day, making me feel useless.

Let´s all not accept the "ONLY TIME YOU TELL" and "YOU HAVE TO WAIT" answers. We have been through everyting the law requests us to do. We have paid fees and we deserve information.

A Consular officer from Rio told me yesterday that they couldn´t inform everyone on time, and they had this girl coming yesterday for her interview and she was only told about her case being cancelled when she got there.

Worse than that: ahe had her american fiancée there with her, who came from the United States just to attend to the interview with her.

And there´s nothing the Consulate can do.

The thing is, these petitions are not considered aproved at the moment. They need to be security checked one more time to attend the new law, that USCIS did not pay attention too.

First of all... This is the best way to find out more:

WE HAVE TO KEEP CALLING THEM: USCIS, NVC AND THE CONSULATES.

As one of the 5 officers from USCIS I have spoken with told me: I was his 6th phone call regarding this recall thing and he didn´t know what to say, so they were all talkingwith each other to find out more about it.

If we keep calling them, they will look for an answer.

Second thing: Some of them say more, some of them don´t say a thing. That´s why we need to keep calling. We will sometime get to the right person!!!

This is what I got:

1) All petitions already at the Consulates that have been filed after March 6th are being returned. Regardles of gender, how the couple met, or anything. USCIS need to perform a new Security Check on these petitions.

2) According to the Consulate in Rio, after that, USCIS will send the petition back.

They said the petitioner won´t need to do anything. There´s no new form or whatever.

3) This information doesn´t match with what I read in another post when a girl copied a letter she received from the Montreal Consulate. Also, a guy from London received a letter saying USCIS will perform new checkingsa and will send something to the petitioner to fill out.

The USCIS officer told me 15 minutes ago that they will do this security checking and send it back with no need of a new form.

4) I heard about some people who have recently sent the I129F form to the USCIS, who filled out something named Affidavit of Criminal.

DOES ANYONE KNOW ANYTHING ABOUT THAT?

We didn´t receive anything regarding the petitioner´s criminal records. That might be the answer.

5) USCIS told me today that they will only have more information about my case after they receive the petition from the Consulate. She told me to give me 30 days after the Consulate sent it back to them to givethem another call. She said 30 days because she doesn´t know how long will it take for them to receive it.

She also told me that she could only release information about my case to the petitioner or attorney. Not to me. But 10 seconds later she told me all this...

And oce again, that varies from officer to officer. I called them a billion times already and they had never told me that.

6) It DEFINITELY is a USCIS mistake! Even the Consulate Officer said that.

She couldn´t say how long will it take, though.

7) We need to find out when the petitions submitted after March 6th started to be security checked as the new law requests.

THAT´S THE ONLY PATTERN WE WILL HAVE.

It´s not about anything else rather than when the petition was submitted.

My petition was sent on March 29th.

8) What is happening with the Service Centers? Even Vermont have slowed things down. It´s not a backlog because of the returned petitions, since the Recall started last week. Is this New Security Check a long proccess???

Or did they stop to wait for new advices???

9) PLEASE, whoever got their interview cancelled, post here any news you get. I read about a woman going to an apointment in her local service center. Please, inform us what they told you.

To schedule an apointment with them (and all petitioners should(, go to www.uscis.gov and click on the infopass appoinment at the top right corner. It´s free and it´s pretty fast!

10) Let´s all call them all the time!!!

It´s not about complaining about the law. It´s done. Ok. We know it.

It´s about asking them to have a heart and understand that since the beggining of the case, this is THE FIRST TIME we don´t have a clue of what´s hapening now and what will happen next.

We deserve that.

And let´s also keep checking for our case status online! Mine says: approved on April 17th as it was...

We do need some update!

Most likely my petition stuck in this new security check, since my receipt date is March 8th, and for the last

3 weeks I've been told it's undergoing security check since April 20th and they don't know how long it will take.

You have to call your congressmen! Now! Today! Ask to speak to the immigration specialist on staff. If you live reasonably close, go visit them. Express your rage at the entire application process not only being stopped, but REVERSED!

This is insane!

It drives me crazy to read posters say- Just wait! Be patient! Be a quiet sheep! That is #######- our rights as citizens to pursue happiness and love where and how we chose to was trampled by the IMBRA law.

Furthermore USCIS is a total cluster ####! If they were a private company accountable to their customers, they would have been out of business years ago.

There is no earthly reason a fiancee visa should take more than a couple months from application to approved visa. There is no excuse. People must be held accountable for this not happening.

Today I made my 4th call to my Congressman's office and I will continue to call them until somebody fixes USCIS.

The squeaky wheel gets the grease. Don't be a sheep! Make some noise!

What's driving me insane is that for the past 2 weeks I've heard no news from Vermont at all. It seems they simply shut down.

They're still issuing NOA1s, but they're not processing any cases from that point on. What we want to know, I believe everyone here is concerned about this, is how long will it take for them to digest this new law and do the new security checks so our applications can be sent to the consulate.

Hmm.. My NOA1 was FEb 17th..... and i emailed then and they said

"Your petition is undergoing security checks, which is required of all applications and petitions, there is no time limit to this process. Please inquire again in 60 days if you do not receive an approval letter or a request for evidence."

do you think I am going through the same new security checks? :unsure:

I am in California service Center....

so is people were approved in March.... and I havent even been approved yet do you think i will be affected too? and that is why I havent been approved yet?
