I have been married to a US citizen for 3 years now.We had our first interview in Mar 05 and at that time only my background check was pending. since then we moved to florida from CA(where i applied for my GC).We have another interview on sept 01 in tampa,fl. Our I130 has been approved earlier this year. In the interview letter, they ask for I864 and 3 letter from those who knew that our marriage is legal.

My problem is that both me and my wife are unemployed.I havent worked the whole year and my wife did earlier in feb 08.We have been on vacations out of country almost until aug 4th,mostly out of country. Now we both are looking for jobs. but if we cannot find the job until the interview date, what are the consequences. We had earlier submitted I-864 when we did the application in 2005. This situation really scares me as i dont want to loose it from here.Any suggestions is highly appreciated.

Thanks,

hipop

First, they aren't asking for affidavits affirming your marriage is legal. They are to attest to the validity and/or bona fide nature of your relationship. Your marriage certificate is all they need to know you are legally married.

You will need a current I-864. If neither income or assets are sufficient to qualify, you'll need a co-sponsor.

I thought the I-864 doesn't expire. Why the need of filling out a new one? That would mean someone has to fill out a new one when there is a change in revenue. It seems cumbersome.

AOS Approved on 10-17-08 (details in profile)

Removal of Conditions on 07-19-10

In this tedious process, we tend to forget that this is all worth it.

I love my hubby beyond anything in this world.

As a contract it doesn't "expire" but it isn't a contract until AOS is approved. To approve AOS they need a recent I-864. One submitted in 2005 cannot reasonably be used to evaluate the public charge concern in 2008.

I dont know what to do if i dont find a job by the end of the month.I am paying mortgage on my home. so will this asset be good enough.how would i convince the officre that i am applying for jobs but if the economy is bad,its hard to find jobs.unfortunately i dont have a co-sponsoror.

Will the tax return forms do any good as we made more than 100K last year and say that we are living of our savings.

I was wondering what would be the worst come scenario if I-864 is not presented. Thanks for your help.

Assets do count. If you are living off your savings, are they significant? How much equity do you have in your home?

You can meet the requirements with income alone, assets alone, or a combination of both.
