Hi,

My fiancé (UK) is going to be filing for a K1 visa soon, but I have a question about me using public funds. I know that the person immigrating to the US cannot use public funds, but can I (the US Citizen) use public funds? I might need to use emergency Medicaid for an emergency room bill I just received. Is Medicaid considered public funds? Would it hurt our case (either for the K1 or for when he adjusts his status) in any way if I use Medicaid this one time?

All they (USCIS) cares about is you (or using a co-sponsor if necessary) meeting the income requirements. If you can do that you're fine. You as the USC have the right to use public funds.

If you are eligible for Medicaid, then you are already a public charge, i.e., someone relying on the U.S. government for your support...for whatever reason. So the USCIS can quickly see that you can't support your fiance.

You would need to find a sponsor whose annual income is at least 125% of the poverty level.

Using medicaid is not a problem. However, if you qualify for the program, do you have the necessary income to sponsor an immigrant?
