visa expiring what to do

so me and my wife got married a few months ago, we didnt apply for either AOS or EAD, the big problem is that my visa is about to expire, we have no idea of what to do or how to file in for AOS or EAD ( as in both at the same time or how ? ) i'm really worried that i will be sent out of the US and banned after all the work we did to finally get together. Please help us. :crying:

What visa did you enter the U.S. on...a K-1? A K-1 is a one time entry...the I-94 is good for 90 days. Past that you would be out of status until you file AOS, in which case you would be status pending.

yes it is a K1 visa and the I-94 did expire.

IMHO I would get that AOS application filled out and mailed off as soon as you can. Until you do and they receive it, you are out of status.

File for AOS and EAD together...it costs less money and also, you'll be OK with the immigration laws. As soon as possible....it's a lot of work to pull everything together but you knew that day would be coming, right?
