Once again, we are beating a dead hourse, but being a sole propritorship, the Kiev Embassy says they look at Gross INCOME, LINE 22 on IRS 1040 to see income . The current 125% poverty level amount stated for TWO people, petitioner and Beneficiary , is $17,500, but will go up in 2009 again, so one would think that if you had $18,000 in income listed for YEAR 2007 filing you'd be ok? I have read so much where posters have stated that if income isn't showing over $20,000 on taxes, then its possible to get rejected and others say its a PASS or FAIL. Kiev would not discuss this with me. Is it a PASS or FAIL system with $17500, or does it have to look better. I ask once again, as I am self employed and this line shows $3850.00 in 2006, because I can write off so many things, and if I HAVE to make this show $17500+++, its taxes out of my pocket, so i don't want to pay on 20k if not needed

Hope someone has past experience with this?

Marriage certificates and US Citizenship documentation are pass and fail. Finances are subjective. How do your assets and bank records look?

Thats a good questions and brings up yet another point! I own a house that I bought last year. The business is a one man show and thats it, records are records, given to tax man and make the IRS happy. The FIRST lawyer I spoke to when I was speaking about Kharkov said that he has NEVER listed any assets or anything else on a K-1 app when the income showed over the 125% numbers, and he states that no one ever was rejected because of it, which led me to believe that they only look that you make over what they ask for , so you can see my confusion still, as you ask about assets, when I was speaking abopve the threshhold level? Thanks

It's true you can skip all questions related to assets if your income is sufficient but based on your statement you don't wish to pay any more taxes than needed, I thought of using the assets as to make up for some income. Three dollars in liquid assets can replace a dollar in income. It's an option to consider.

Bite the bullet and pay the taxes on whatever it takes to qualify. Have them ammended in a couple years and get your money back!

All good answers, and I thank you. Not enough assets to make up the difference, so I guess we'll give it to Uncle Sam!! Ain't love grand???What was that song..."the things we do for love"???

Un less you have enuf 1099s. It's best to get tax trancsripts from IRS if you are self employed. BEST even if you do have enuf as tax transcripts show you have filed. Normal tax returns don't really prove much of anything.

Surprised USCIS doesn't require tax transcripts in all cases yet.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Un less you have enuf 1099s. It's best to get tax trancsripts from IRS if you are self employed. BEST even if you do have enuf as tax transcripts show you have filed. Normal tax returns don't really prove much of anything.

Surprised USCIS doesn't require tax transcripts in all cases yet.

Try submitting an I-864 without either transcripts or returns plus income documentation and see how fast it comes back to you. A "tax return" includes all supporting documentation like W2's and 1099's etc. Anybody can produce a 1040 and other schedules with any numbers they want. USCIS know such submissions are meaningless, so they in fact do require either income documentation or a transcript proving you actually reported the income to the IRS.

I like the idea of amending the return after the green card is in hand. I'd rather loan the IRS money than give them a gift.
