Ok here the deal my canadian g/f was going past customs. and the customs officer stopped her and told her that she couldnt get a AOS or get married while she was down here... we planned on getting married and filing for a AOS. what should we do?

She told him that was her plan? Because hes right..you're not supposed to come to the states with the INTENT of getting married and filing for AOS..if it just happens she was here for a visit for a few months and decided to..thats one thing..but crossing the border with the intent to marry and file is a big no no...

03/03/08 NOA(I-485,I765,I131)for daughter and myself

03/09/08 received biometrics appointment letter

03/25/08 RFE recieved for NOA for I129F(USCIS lost it! DOH!)

03/26/08 biometrics appointment(YAY!)

03/26/08 EAD touched(for daughter and myself)

03/28/08 EAD touch again!

04/03/08 RFE received case processing resumes

She told him that was her plan? Because hes right..you're not supposed to come to the states with the INTENT of getting married and filing for AOS..if it just happens she was here for a visit for a few months and decided to..thats one thing..but crossing the border with the intent to marry and file is a big no no...

no she didnt she said she was coming to visit friends

If you were PLANNING to get married while she was here on visitor status, that is visa fraud.

if we did get married and filed for aos would what customs told her make a diff?

Could be that by now the customs officer made some sort of note on her file - about warning her. so what do you think?

well yes, because she was told not to. but i don't know if they can track that down.

Yes, it does. For an enforcement officer to tell you you can't break the law certainly seems "allil (sic) god like." I mean that would be like a cop telling you you can't exceed the speed limit when you drive! Where do they get off, thinking they have these god like powers to enforce the law! I'd get married, then report that officer for informing you of the law! But I'm not a lawyer so you better check that first.

Well it's a law, she can't. Usually it's not something they mention but there has to be a reason they told her not to and in doing so she shouldn't. It is against the law to have immigration intent on a visitor's visa. Some people get through with it but this warning makes things different.

i dont think its against the law to get married only to enter with the intent to get married. if he had said ... if your coming in with intent to get married that is against the law. but he told her that she couldnt get married at all. and if she did she would never be able to enter the US again.

I have to agree here. If he made any notations, you will be caught. And that will mean a banning. Are you willing to be seperated even longer?

Godlike.... errr... yep, pretty accurate. She was officially warned not to get married. Common sense would be a good idea now.

Absolutely.

What is with the attitude with the agent? He's just doing his job. He suspected something (which turns out to be true!) and warned her. In my mind, that makes him good at his job, unlike some of the clueless one's out there.

If you do this, and he notated it, you will not like how it turns out.

What's the big deal? File a K-1 and wait it out. No marriage is life or death. And, what's a few more months compared to the years you will suffer if you do as was initially planned?

well she can get married, but she has to go back. can't aos, since you guys were planning to get married before she entered and as someone already said, that's illegal
