Hi Julmo,

Tax Returns are never notarized! Who told you that? I am a Certified Public Accountant (C.P.A.). So you will not get denied because of that. :thumbs:

If she does get denied, it won't be because the copy of the tax return wasn't notarized.

i sent packet of to fiancee and i didn't have my tax return notorized will she get denied.

The DoS instructions for evidence that may be submitted to meet the public charge provisions of the law does say that copies of tax returns should be notarized. However, I've never heard of anyone having a problem with submitting copies that were not notarized.

By the way - you may be a CPA, but you are not a DoS consular officer. They have their own set of rules to follow.

I just gave Claudeth a copy of my returns the tax guy gave me and we were fine. Good luck

Does notarization make a document "true" or "legal"?

No. A notarization typically means the signer acknowledged to the Notary that he or she signed the document or vouched under oath or affirmation that the contents of the document were true.

I think that the 2nd item applies - the notary is witness to the person's affirmation that the copy of the tax return is true and correct.

I made copies of my original tax transcripts and had them notarized as accurate copies of the original

You are dealing in an area that I am an expert on. Without going into my Masters Degree and career. I worked for KPMG Peat Marwick one of the big “Three”, the biggest three accounting firm in the world and now I am a director for a fortune 100 company. I deal with all type of national and international laws.

There is no way to take Tax Returns that have been done to get notarized. Tax Returns are done by an accountant or the individual and it is sign and dated then it is sent of to the I.R.S. You can not get the Tax Returns for say 2002, 2003 or 2004 and take it to the notary to get them notarized. The tax returns have already been sign and date and at no point did it require a notarization by the I.R.S.. Do you understand this or do you need further explanation?

Notarize is to certify or attest to (the validity of a signature on a document, for example) as a notary public. This is the definition of notarize!

Actually the definition of notary public goes beyond witnessing signatures:

"Someone legally empowered to witness signatures and certify a document's validity and to take depositions"

I know the packet sent out by the Manila Embassy includes instructions which specifially request notarized tax returns.

In my earlier post I indicated that I used the notary public to certify that my tax transcript copies were true and accurate copies of the originals.

You may be an expert in tax accounting, but that is not the area I am talking about.

See my post quoting from the National Notary Organization. As john_and_marlene are also aware, Notary Publics can do more than just witness signatures - they can also witness affirmations.
