worried about my status (K1)

I was petitioned by my ex American fiance before way back 2004. our relationship didn't work, before the 90 days get over i went back home ( Philippines) to avoid breaking the law. When i arrived PI i just noticed to my passport that i still have the I-94 card, so i went to USEM to see if i can surrender my I-94 card there, but they give me a instructions what to do and where to mail it, so i did, but never heard any response from them.

my question is do i need to cancel those K1 visa before? or its already void since i went back home before the 90 days end? i have a K1 petition right now and its been a while since we filed it, we never get any updates nor touch even fiance already called them. I am much worried since i'ved seen some applicant get thier NOA2 now that we even filed earlier than them. All we wanted is to know whats going on, on our case if we got some problem to it, so we can fix it now not later when its to late already.

You used the previous K1 ... it was a single entry visa. There is no way to cancel it after use. It will not cause a problem for petition approval, but may be asked about during the consular interview for the new visa application.

hi there.....i think ur k1 before affects your k1 petition now.....just wait till aug 13 then try to contact them again.....good luck and god bless

The K1 was void upon entry--it's a one-time entry visa.

If the petition was left in limbo you would have a problem but you activated the K1 upon entry and then you're just riding your I-94. The K1 is just to enter the Country with the intent to immigrate. If you did not marry and you left before the 90 days you should be good to go.

There are still plenty of folks waiting at CSC from February.

from what i have read as long as it has been two years or longer since ur first k1 and u left the usa before ur time was up on it then the fact that u came here on k1 visa before has no effect on the one that is filed now.........at least that is my understanding from what i have read

thanks to all of you guys. it makes me relieve my worries. im just really worried about this cuz it didnt went to my brain till one of my friend told me some instances. i also have the strong feeling that my previous K1 was void already since i went back home before the 90 days, it just i forgot to surrender the I-94 on the LAX immigration booth during that time but yet able to mailed it at the said address the USEM gave me, but never get any response from them. this is just what botther me now. thanks to all. First of all congratulations on returning within the 90 day window. That will be key in getting another fiancee visa. As mentioned, the K1 visa is used once, and once only. At 90 days, you have to leave the US if not married. Even with the same fiancee, you would have had to have reapply for a new K1. I know a Colombian young woman who had two K1's within 2 or 3 years. At 80 days, the first guy told her to go home (a jerk). Now she is happily married and living in the states.

THank u! i also want to let you know that u never regret going back home before, now i am mush happier than ever. this is what im looking for and love and respect from someone who i love in return, just worried with many things around since we never get our NOA2 yet. please help me pray . thank u guys.
