Hi everyone,

With everyone's assistance I got here in the forum I am almost done with my AOS except for the I-864 form.

My husband's recent annual (2007) salary didn't make the 125% poverty guideline but he was able to get a job early this year that makes it above the required. With the pay stubs we've collected he is already over the requirement. Should I indicate his 2007 annual earning on the I-864 form (where it says recent annual income) despite it being below the poverty guideline and attach his pay stubs and employment letter to indicate that he is now earning more?

Does anyone of you have similar situation like ours? Thank you much for all your help!

07.25.08 - Checks encashed by USCIS/Notice Date on NOAs

07.28.08 - Received NOAs for I-130, I-485 & I-765 in the mail

When I answered the question, I annualized the current status and not my historical information. However for me, my income exceeded the poverty level for either year.

Most people's GROSS income is well above, the I-864 is asking about GROSS income, NOT take home pay.

Most people's GROSS income is well above, the I-864 is asking about GROSS income, NOT take home pay.

I'm actually worried about his 2007 gross income. It's complicated but to make the story short...he was making above the 125% poverty guideline from his previous employer. But on the W2 form his previous employer reported less of what his actual salary was.

Right now he is making above the 125% poverty guideline and his recent pay stubs shows that. Can I indicate the gross annual income he will be making this year on the Part 6 Question 23?

Yes, indicate the gross annual income he will be making in the current year 2008. As long as that's >125%, you're fine.

Yes, indicate the gross annual income he will be making in the current year 2008. As long as that's >125%, you're fine.
