Claiming abuse in divorce

Hi! I would like to know for those of you that file for abuse waiver and got approved, do you claim abuse in your divorce proceeding?

I know in CA, it might affect the length and amount of alimony, but I am not sure if I want my spouse to know that I filed for abuse waiver. He can get real nasty and says mean things.

I never filed an abuse waiver - we had not even had the interview yet when my ex assaulted me. I filed a VAWA I-360 self-petition. For me, it didn't matter what was in the divorce papers. In fact, USCIS only knew about the divorce when I had my interview on May 20, 2008. If you have evidence to back up the abuse waiver to remove conditions, I would think that USCIS would grant it. I am in NY - I didn't want or ask for spousal support at all - I just wanted to end my marriage to him.

September 15, 2011: Oath ceremony @ 8:30 AM

If you are living in a no-fault state, the grounds for divorce are not necessary. Also, depending upon your state, temporary spousal support could be awarded to one party if the divorce would render him or her in a lifestyle dramatically different to that experienced during the course of the marriage, however, this usually occurs after a long-term marriage when one spouse was earning dramatically different wages than the other or when one party weas required to stay at home while the other enjoyed a fruitful career, and now after the divorce they find it impossible to secure work. Also, alimony, or support, is generally only awarded in short-term marriages on rare occasions, to assist one partner in the transition from married to separate.

One thing to do is to get a restraining order on your spouse and keep a record of it, found that is something I had in common when I first met my wife, the good one. Didn't do a bit of good in our divorce courts as both her country and my state has no-fault divorce laws, but it gave her and my children peace of mind. People that attack family members may also have some kind of mental problem, and you may not be dealing with a sane rational person. May also be helpful with a police report on your I-751, although I have no experience in this.

No-fault divorce laws are about the dumbest thing I ever heard of when you have a spouse that beats you, commits adultery, gambles or drinks or wastes all of your money away, or is cruel toward your kids. Certainly expressed my opinion and experiences with my state senators and assemblymen, all agreed with me, but still haven't changed the law. And if you only have a can of beans left after your spouse left you and your kids destitute, that spouse still gets half that can.
