quick question,

after i get married to my fiancee then we go file AOS for her will it take along time to get the green card? im just worried if it takes a long time for the AOS and her K1 visa expires will it cause problems for us?

N400 sent : 2011-11-18

N400 received & check cashed : 2011-11-28

N400 interview letter revcd: 2012-01-23

N400 interview: 2012-02-29

N400 oath: 2012-03-21

As soon as you get married and file AOS, you don't have to worry about the K-1 Visa being valid anymore. You just wait for your AOS to get approved and receive your GC.

Just remember not to travel outside the U.S. without first having either the GC or Advance Parole.

Sept. 9/08... SSA office to change status to "U.S. citizen"

July 12/11..... Oath Ceremony

It should usually take 3-7 months, altough you can not predict what the USCIS will do, how fast they will process you.

The expiration of the I-94 should not cause major problems as long as you are married within the 90 day timeframe. Then file for AOS as soon as possible.

You should take advantage of her K-1 status, because she will be able to get a drivers license with her valid I-94, you should apply for her SS number. And do not worry top much. Most of the people's (K-1) I-94 expires before they get their green cards. Simply the legal status after this expiration and filing for AOS is "AOS pending".

Biometrics notice received- July 14th (notice date- July 9th)

RFE response received by USCIS and case processing resumed- September 12th

AOS Touch- September 18th

Transfer to CSC- September 26th

AOS Touch-September 29th

Received Transfer Letter in mail- October 2nd

AOS Touch- case pending at the office to which it was transferred- October 3rd

AOS Touch- October 6th

EAD Touch- October 29- CARD PRODUCTION ORDERED-yippeeeeeeeeee! I can get a drivers license

EAD Touch- November 3rd- Approval notice sent (JEEEEEEEEEZZZZZZZ RIGHT AFTER I WROTE THIS MY EAD CARD CAME IN MAIL!!!!!! I mean the Mailman brought it HOW WEIRD IS THAT???????????)

Yep. That might be right. I would check. I forgot the US is so big, and every state is different. But I would check into that since taking advantage of the status before it expires and you can't do anything anymore is a good idea.
