Hello. I entered the US with a K1 visa on the 19th of June and married my husband on the 28th of June. I have everything except marriage certificate. On the visajourney, we should bring the form in person and let him or her record our mariage information and get a marriage certificate. HOWEVER, Orange County, California does not take any marriage document in person. So, we mailed everything on the 30th of June and now we are waiting for a marriage certificate to be recorded and issues. Since I am supposed to file AOS as soon as possible, is it ok to wait for 2 -3 weeks? I called up USCIS and the lady on the phone had no idea what she was talking about. She said, If I were you, I would write a letter and file. I asked her, so does it mean that I will get RFE later on? she said, yes!. Well, then should I wait? she said, yes, you should wait. OK, she kept saying two things which are completely different.

How soon did you file AOS?

7/19 AOS package has been mailed

7/21 AOS package was arrived in Chicogo.

7/28 NOA1 for AOS, EAD, AP

8/15 Biometric done

2-3 weeks... 2-3 months... 2-3 years... based on members experiences all appears to OK>>>

You will be fine. Most people like to file for AOS right away so they can get their benefits (EAD, AP, Green Card) sooner than later. It is suggested that you file within the time that your I-94 is valid (up to 90 days upon entry to the US), but others have filed after that date. It's better to wait for your marriage certificate and then send your AOS package than it is to send the package off without it and get an RFE or have it be refused/denied.

11/29/2007 - Infopass appointment - file was sent to a storage facility before it was finished processing.

05/28/2008 - Received AOS Interview notice

07/10/2008 - AOS Interview-APPROVED pending fingerprints

09/22/2008 - GREEN CARD IN HAND!

Removing Conditions

06/04/2010 - Sent I-751

06/07/2010 - NOA1

06/09/2010 - Check cashed

07/22/2010 - Biometrics Appointment

09/08/2010 - Card production e-mail
