My fiance visited me recently in the Philippines last couple of weeks ago but he told me that he filed for bankruptcy this year January 2008 they have some issue with his ex wife but i certainly knew why he filed for it,but my question is "if we filed our petition this month is there any chance that we will be disapproved in USCIS in the future?Please i need some advice before pursuing this petition cz we can file later or next year(even if its way to long.. :whistle: )as long as all things are into places.I need some suggestion please :help: .

From what I've read, a bankruptcy will not affect a family based visa. Only a business related one.

They don't check the sponsors credit history, just that they earn enough to qualify.

Thank You God's Girl and Lorilawless,i think we're good to go,i dont listened to him coz i thought it will be a hindrance in our filings.. :innocent: about his income,he is above the requiered poverty lines,so i think his last ITR last year is way to high(that's what he said :innocent: )so i think we dont need a co sponsor,now im relieved... :thumbs: Thank you very much for the information gurls :star: We will start the paper works this week and our service center is California.

Keanna I am going through similar issues. I have to file for bankruptcy soon and I am worried that it will affect the affidavit of support that I have to file. I have asked the bankruptcy question and almost all of the replies have been that it will not affect anything. I have also spoken with a few lawyers and some say it should not affect anything and some say they are not sure. I will know very soon since my fiancee's interview date is April 23rd. I have not filed for bankruptcy yet so it may not affect the initial affidavit of support but I am more concernced with the affidavit of support I will have to file for the Adjustment of Status after we are married. I will let you know how it all turns out. Good luck and I hope all goes well for you.

Not an issue unless there is some IRS tax lein, unpaid child support or something. They do not care if a petitioner defaults on credit cards, car payments, home mortgage etc.

The I-134 is not a credit check and does not contain any questions regarding credit history, payment obligations or any such thing, and it is not filed with the I-129f. The bankruptcy should have no affect on your case and if the petitioners income exceeds the guidelines you will not need a co-sponsor.
