Hello

I'm brand new to this forum, so forgive me if this is a question that's repeatedly asked, but I'm currently in the process of applying for the K1 fiance visa. Obviously, these things take time, but equally obviously I want to see my girlfriend and the kids as much as I can.

As such, I've booked a week's holiday leaving on Wednesday. Now I know that as soon as I arrive at immigration and have my passport scanned, it'll flash up on the immigration officer's screen that I have a permanent residency application pending. I assuming that once I explain to him/her that I'm only in the states for a week, and that this week long holiday has nothing to do with the K1 application, that there won't be an issue? I will have a return ticket that I can show, plus a week's car rental agreement showing that I intend to return the car to the airport I got it from. It should also be noted that I've received no notification whatsoever from USCIS that I can't do this, so I'm assuming it's fine.

Can anybody recommend any other type of supporting evidence that I should have ready on arrival?

I called the Border Patrol people and posted my conversation in this thread.

Hi Damian, welcome to vj and good luck with your petition.

Other supporting evidence you can use is a rent agreement or mortgage papers or even a letter from your employer stating when you are due to return to work.

I hope you have a good trip.

Well, seeing as that question was answered so quickly, perhaps you fine people can help me with another!

My application was received and marked as "pending" on 19th February this year. It is with the California Service Center. Thing is, four months on and I've heard ####### all. Nada. Zippo. Squat. Is this normal, or should I be worried?

California is slower than vermont, if the check has been cashed you may be able to see the reference number on the back of the check, if you can you can track it at the uscis website, every time the date changes that means its been touched, moved. I would think your approval should be forthcoming soon.

Also, for clarification, you don't have a permanent residency application pending. A K-1 application - fiance/e visa is a "NON-immigrant visa". Even the K-3 'Spousal" visa is a non-immigrant visa. All the K-1 does is allow you admissions to the US to get married within 90 days. If you don't get married, then back you do - the visa cannot be extended and it cannot be changed. Once you fulfill the purpose of the visa - to arrive and get married within 90 days - you then have permission to request an 'Adjustment of Status" (AOS) from non-immigrant to immigrant. When you submit the AOS, then you will have a request for permanent residency pending:-).

Having your return ticket and the return car rental will be good. Add to it proof from home to show you still have ongoing commitments that you intend to fulfill - going back to work (a letter from employer), rent or mortgage payments due, utility bills due, homeowner's or vehicle insurance valid for several months after your stated return, car payments, ie.
