Hi everyone,

I've run into an odd situation.

I submitted my form I-865 (Sponsor's Notice of Change of Address) when my husband and I moved from MI to CA. There was no problem. We recently moved again so I submitted the I-865 again but they sent back a standard from where they checked off: "our records indicate you have no relation to the case." I figured someone made a mistake so I sent it again and then it came back with a special form to fill out and the person wrote that I needed to send a copy of my 797c. So I did that. They sent it back to me again! Now I am totally lost.

I called the help number and they basically told me to find help on the internet or get a lawyer. (great help eh?)

A quick history is that my husband and I were living in Australia where we married. I then sponsored my husband to immigrate to the USA (at the US consulate in Australia) and my mother was a co-sponsor because I was a student at the time and not earning enough. We first lived with my mom for a few months until we moved to California where we are both working now. And as I said, the first change of address went well.

I don't understand what I should do? Does my mom (as the co-sponsor) need to fill out the I-865 too? Of course she hasn't moved so that doesn't make sense. Are we supposed to LIVE with the Co-sponsor and never change our address unless the co-sponsor comes too? Of course that seems ridiculous but...

If anyone has ANY insight at all I'd appreciate your help very much.

Many thanks.

Are you close enough to an immigration office to make an INFOPASS appointment and bring along all of the forms and documentation necessary to change the address? That might be the easiest thing to do. If any questions arise during the appointment you would then be able to answer them directly rather than this back and forth situation. And yes, the Help line is really just a call center with 'canned' responses. If you press hard enough you can get transferred to an Immigration Officer but sometimes they won't do that. Try the INFOPASS appointment route.

I think you originally filed the wrong form. I-865 is for the sponsors change of address. AR-11 is for the alien. Maybe you confused USCIS.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

Actually both the AR-11 and the I-865 are supposed to be filed with a change of address - one for the alien spouse and one for the USC sponsor. You are the sponsor and your mother is the co-sponsor. They should have accepted your change of address as sponsor. Check it out with an INFOPASS appointment. Good luck.

Wow, that is really helpful. I am actually right near an office so I will schedule an appointment. I didn't know that was a possibility. Thanks for the tip Kathryn41! I feel so grateful to know that there is a forum like this where we can all help each other too. Immigration can sometimes feel really stressful.

Oh, well on further inspection the office will only see you for certain reasons and filing an I-865 is not on their (the San Francisco Office) to do list.

Too bad!

At least now I know that the sponsor and co-sponsor are not expected to live together forever and ever. Right?

I think I will try to get someone on the phone if that doesn't work I guess I will have to photocopy my entire case and present it in a very long letter. Unfortunately, but if that's what it takes, that's what it takes.

Unless there are still more ideas out there or if someone has actually had this happen to them?

Thanks!
