My husband's I-94 expires in 6 days, and we just realized that we don't have his birth certificate. I have NO idea what happened- we tried to be super careful and make copies of everything we gave at our K1 interview, but we can't seem to locate this anywhere. From what I understand, the only thing we can do now is send his mom to try to get another copy, but it's going to take some time and I don't believe we can get it here by the time we officially have to file for AOS.

I have read that many people have sent their AOS paperwork well past the deadline, but I'm very nervous about that, for obvious reasons. So my question is this: would it be better to wait until we have the new birth certificate in hand and send the AOS paperwork after the I-94 expires? Or should I send everything else on time and just wait for them to send an RFE for the missing birth certificate? Any opinions would be greatly appreciated.

Bottom line it is a personal choice... Either has positives and negatives attached.... Figure an RFE will delay you 3-4 weeks. How long willit take you to get a new BC and then choose... An RFE on you AOS application will stop your EAD/AP application (if not already approved) so that is a risk as well if that is important for you.

As long as you two got married within the 90-day period, it doesn't matter if you will submit the AOS right away or not. It won't affect the application in the future although as long as you don't file AOS or EAD, your husband cannot work legally. Some people submitted AOS without the birth certificate. While most of them received RFE for it, some made it through without it. And those who received the RFE, they have a copy ready by the time the request was received.

There isn't a deadline!!~

I'd file the AOS without the BC and get another on it's way here. You may get a RFE or not. Just have it for your interview.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Send it in without the birth cert, wait for the birth cert to arrive

(assuming it arrives before the RFE from USCIS), then copy it and respond to the RFE.

just wait for the bc do not worry =)

There are no deadline for the aos.

If you want to submit it now you can, USCIS will ask you for a RFE.

You can also wait for the birth certificate and send all the documents together.
