My I-130 was appoved last May 6, 2008 and My I-129F has an RFE and we sent it back last May 20, 2008.

What is an AOS and IV Bill Online?

Thank You

Irene

hi there Irene, please click this link that will lead you to another forum relevant to this thread and your question: http://www.visajourney.com/forums/index.ph...p;#entry1862225

AOS means : AFFIDAVIT OF SUPPORT

IV BILL means: IMMIGRANT VISA BILL

These are applicable for CR1 visa. We are a vermont filer and this service center seems not approving I-129F lately we are forced to take the CR1 visa which is better than K3 anyway. Goodluck.

Thanks so much for taking the time to answer!! Knowledge is power and a truly valuable thing - so to find someone willing to shares theirs so freely... You are a kind and generous person and have warmed my heart! Thank you again! :innocent:

hi chandra,

If u want to file for a k3 visa, first file the I-130 then when u receive the First Notice of Action (NOA1) u file right away the I-129F. If u got lucky both ur petitions will be approved then most likely u're in K3 route. If ur I-130 will be approved first than I-129F, thats the time for you and ur husband to decide which visa u want. Go for CR1 or wait for the pending I-129F to be approved. U cannot file for CR1 if your I-130 is NOT approve yet. I will share some posts that i read before, i hope this will help you.

I-130 by itself will result in a CR-1 IMMIGRANT Green-card visa. To do K-3 you file I-130 first, then wait for USCIS receipt letter and then file I-129F along with copy of I-130 NOA1 letter to start K-3 visa process. 130 is for immigrant visa, 129F is for NON-Immigrant K-Visas. Note: for most countries, the I-130 CR-1 process is not taking much longer than K-3 visa. CR-1 has the advantage of a green-card upon entry, which allows WORK, getting SSN, and even applying for a Driver's license. K-3 cannot do these things untill getting EAD or Green-card. EAD can take 90 days or more. So if the prospective immigrant wants to work, or drive, they will need to wait several months when entering on K-3, but CAN do these things imediatly when entering on CR-1. Also K-3 has the added costs.

I put your response to me above BOLD and in italics... :)

I saw you mention that you believe that the CR1 is better than the K3 and that you are going that route for your application yes?? I see the point of having the greencard upon entry - how that can be a benefit... but we are not so worried about that - my husband will be just finishing a mission in Iraq around the time we HOPE this will be getting approval - so a 90 day break seems like it's in order for him!!

For my husband and I our main concern is SPEED! gee I'm sure I'm the only one that feels that way:) LOL of course $ is a consideration as well... do you know HOW MUCH cheaper the CR1 ends up being??

and 2nd - it's my understanding the K3 is faster... do you know or have you heard which of the K# or CR1 it the faster when considering Eastern Europe/Romania??

Again - I am truly grateful for your insights and assistance!

Sincerely

Chandra

Can someone explain to me or help me understand...

I need to start this process (visa/immigration) for me and my husband - but I need to figure out if I should file a K3 Visa app or a IR1 or CR1... or here is where I get REALLY confused; by filing a K3 am I somehow filing or considered filed for a IR1/CR1 OR should I file for both to be safe???

I of course like everyone want this to go as fast as possible - and it seems to be that I file K1/fiance stuff - all sorts of papers must be filed... BUT how do I do or make this go the fastest??

My gut tells me to file for K3 - any advice I'd so appreciate!!

Chandra

SO SORRY IF I POSTED THIS IN THE WRONG PLACE I JUST NEED HELP!!!

if u are married u are allowed to apply :

1.) 129F (K3) non-immigrant visa this visa is temporary for 2 years GS and before this visa expired u needed for Adjustment of Status (AOS) that cost $ 1,010 plus $ 70 for Affidavit of Support (AOS) to be an immigrant. Failure to file AOS k3 holder in 2 years is subject for deportation.

2. 130 ( CR1) immigrant visa - after a month u will receive welcome letter & GS. Please check USCIS or NVC for corresponding payment.

note : when u received NOA2 for both 129F and 130 i suggest go with CR1 ( 130 ) less hassles.

in my case i got approved in both applications but noticed from NVC for 130 (CR1 )delayed for 2 weeks. I got early noticed from USEM for my 129F (K3) reason i set-up my appointment right away with K3 flow cause my hubby wanted me to be with him on his birthday. I told him that he is going to pay more if i have to choose K3 he is going to pay 1010 & 70 bucks for AOS but he told me it's okay. I'm just glad i passed my medical and interview.

Your most welcome Chandra & thanks :) Now going back to your question. If ur a Vermont filer please pray hard that your I-130 & I-129F will be approved. I-129F is supposed to speed up the process for K3 applicants but lately vermont's has the history of not approving the I-129F instead most likely they only approved I-130. Like our case, we opted to do CR1 and we are now dealing with NVC though its okay with us coz we rather want CR1 than K3.

CR1 visa's estimated time process after I-130 approval forwarded to NVC varies 6-8 weeks per lotofpatience nvc fastest steps . http://www.visajourney.com/forums/index.php?showtopic=127253 (in case u'll take CR1 u follow that steps it will helps you)

CR1-Visa

1) Affidavit of Support Bill (AOS) $70

2) Immigrant Visa Bill (IV) $400

K3-Visa

1. I-130 Application $335

2. Adjustment of Status (AOS) $1010, (3-6 mos process unlike CR1 no need for this)

Goodluck!

First congratulations to your speedy K3 approval. If u didn't read me right here lemme reiterate, it depends on which Service Center you applied for your petition. Vermont lately DID NOT APPROVES I-129F (K3) and until now it remains a mystery, as a result petitioners/beneficiaries were opted to CR1 visa. Your case was in CSC this service center always approves K3 petititions. You got lucky ur petition didnt go to Vermont. If u got confused, kindly scroll up and read again the difference between K3 & CR1 under Ms. Chandra's communications, i believe i have stated some of the advantages and disadvantages of the 2 visas. Thank you & goodluck to the rest of your journeys.

Hi, It's Chandra AGAIN - this is my last question and then I think I have it. To file the 129F it shows a fee of $455 - is that included in your aprox cost of the $1000+ figure?

Do we pay that WHEN we file the form? Or does he pay the fees at his interview?

Thanks,

Chandra
